Congress never intended to grant automatic citizenship to the children of those who were here illegally. The Supreme Court just interpreted a poorly worded paragraph to grant citizenship to the child of any woman who can keep her legs crossed long enough to get over the border.

Congress, in the current Nationality Act, very explicitly granted citizenship to every child born here, regardless of the citizenship of the parents. Congress also went further than the 14th Amendment and the Supreme Court's interpretations of it, and granted citizenship to every child under the age of 5 who is found in the United States if the child's parentage or birth place are unclear.

Perhaps I should have worded my comment differently. I should have said "With the 14th Amendment, Congress never intended..." I understand what the current immigration laws say. My point is that the laws violate the 14th Amendment. The wording "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the States wherein they reside." is vague enough to be misinterpreted, but the authors were pretty clear that they didn't intend for it to cover foreigners. It wasn't until much later that this became the meaning du jour.

You are right about the current state of the law. However, as you note, this is a law, not a command from the Constitution. In short, Congress can, by amending this law, eliminate "anchor babies" from the equation. The question is not whether Congress CAN do this, but whether it has the WILL to do this.
