You're not supposed to try these cases in the press anyway. Every prosecutor waits until trial to present the evidence. If Murtha insists on politicizing these acts, and publishing the details before trial, then he's just ensuring that these soldiers won't get a fair trial, and that they'll have to be released.

Perhaps that's all part of his plan -- then he (and all the lefties) can say the "other side" doesn't really care if innocents are "murdered", etc...
