And what "Peace Officer" will be impersonated?

Federal immigration agents (according to the posts). There is a federal statute against that as well, Since more and more local authorities are contemplating enforcing federal laws on the subject, that's why I said Penal Code 538(d) could be implicated.

Here's the California statute:

"Any person other than one who by law is given the authority of a peace officer, who willfully wears, exhibits, or uses the authorized uniform, insignia, emblem, device, label, certificate, card, or writing, of a peace officer, with the intent of fraudulently impersonating a peace officer, or of fraudulently inducing the belief that he or she is a peace officer, is guilty of a misdemeanor."

So, I guess it would come down to what the intent was to "Get an old Crown Vic and paint 'INS' on it and park it near the dweeb's restaurant."

If you drive a car that looks like a cruiser, could you then be said to be "incarnating" a police officer?
