Because, after they escape, it won't be a prison break anymore. They have to milk being in prison for everything it is worth. At least Clint Eastwood escaped from ALcatraz in an hour and a half.

It wasn't a spoiler as the show has already aired and there are dozens of news articles about it including in the New York Slimes. Also, on Fox's front page there is a poll about Tony's death and his character bio says he is "Deceased".
