However, the RIAA lawyer ignores the legally established rights of a secondary market in copyrighted goods. As long as that song has left your possession during a sale, the RIAA has absolutely zero, zilch, nada say in it through the Doctrine of First Sale. Well, at least that's how First Sale should be applied -- who knows how their lobbyists and lawyers are twisting it.

Actually, the terms are pretty similar. The typical EULA says you cannot rent the software to someone, but it's OK to sell it, as long as all copies of the software are transferred to the buyer, and you give them a copy of the terms of use. So, essentially the same position legally, but stated without the attitude that presumes you're out to steal something.
I'll bet it IS a crime. But the SPA doesn't have the gravy train that the RIAA (and MPAA) does.

There was a similar argument going on twenty or so years ago, when Half Price Books and similar knock off stores started selling records, cassettes, and CDs. The industry was upset that second or third generation sales were going on and they weren't getting a piece of the pie. There was talk about outlawing the sale of anything other than brand new media.
