Gonzalez won't go into possible laws that have been violated. Will prosecute if finding are that they have.
Cornyn mentions NY Slimes wanting to know if there is any protection in the law for the Slimes doing that?
Gonzalez says the Slimes has their own lawyers and demures from opining and taking away a possible Slimes defense. LOL!
Cornyn points out the Slimes sat on the info for a year before publishing it.

It's like referring to speed limits as useful tools in a motoring tool.
Fisa isn't there as a tool, but a limitation on power. Your use of that phrase captures the attitude of the admin. We'll use it when we want and ignore it when we want.

Arlen was asked on all the Sunday yakfests yesterday if he would call Mr. Peanut to testify, and he said he has said yes or no yet, but he's considering it.
The media wants him out there because that would give the impression this isn't about impeaching Bush. I want him out there so that all this Democrat hoo-hah can be laid to rest as the bushwa it truly is.

You knew when you answered my question that this admin. was going to find a way around FISA law so how can your response be valid today in light of what we now know.
Gonzales: It's absolutely valid. We don't ignore FISA. The president has authorized activities with what FISA contemplates. Putting aside the question of use of force, while it's a tough legal question whether Congress has authority to limit that authority or elec. surveillance of the enemy, it's not a question we even need to get to.

(3) concerning the communication intelligence activities of the United States or any foreign government; ...
Shall be fined under this title or imprisoned not more than ten years, or both.
(b) As used in subsection (a) of this section--
The term "classified information" means information which, at the time of a violation of this section, is, for reasons of national security, specifically designated by a United States Government Agency for limited or restricted dissemination or distribution; ...
The term "communication intelligence" means all procedures and methods used in the interception of communications and the obtaining of information from such communications by other than the intended recipients; ...(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law--
(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation; and
(B) any of the person's property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.
(2) The court, in imposing sentence on a defendant for a conviction of a violation of this section, shall order that the defendant forfeit to the United States all property described in paragraph (1).
