Just announced on Fox News, the Justice Department is going to investigate leaks pertaining to Goverment Wiretapping and Security programs.

Thanks for pointing that out. My typo of "793(a)(3)" should have been "798(a)(3)." 798 does include the word "classified" in the recitation of what constitutes a violation of that section.
793 & 794 recite a list of specific information, much of which can't be kept secret, and as you noted, 793 & 794 do not include the word "classified" in the recitation.
The question I was probing was that of NYT's exposure to criminal charges for publishing. The Pentagon Papers case is in the same vein as the recent publication of the NSA wiretapping allegation, in that regard, and of 793, 794 & 798, 798 seems to be the only section potentially applicable against the NYT.
That's exactly true. In order to be a whistleblower, you have to blow the whistle. That doesn't mean that you go running to the New York Times. There are methods to combat abuses within the intelligence community that any individual can take. The person raising the complaint would be legally protected from any repercussion or retribution.
Since the source of the leak didn't use the Whistleblower program, they are guilty of unlawfully disclosing classified information, and are not legally protected.
Unfortunately, few of them care to do so. What's more, they have the resources to find the truth on their own if they were so inclined. But this thread is an important resource for those of us who don't have the media's access to expensive tools like Lexis-Nexis.

I am not alone in turning the channel whenever that Clark idiot comes on Fox...and I need to remind them AGAIN..only this time, I will also tell them that I am not thrilled about Novak...
But, I am sure, like the Yankees...Fox won't care, they just want to say they got the top free agent on the market.

Novak, with the exception of a few personal quirks, has been reasonably conservative in his viewpoint most of his career. He is a good journalist, and although now old, is still pretty sharp. He was just on CNN tonite with Wolf Blitzer giving his swansong, as this was his last day with CNN. It will be interesting to see what Novak starts to say now that he will not be beholden to CNN anymore. He may start to talk more freely. He said today that he will speak about the whole Valerie Plame thing in a column as soon as Fitzgerald has folded his tent. Look forward to knowing what really happened here with Novak and what he knows that we don't. Glad he'll be on Fox when he comes forth with his version of events, rather than on CNN. We'll get a more honest commentary indeed.

One thing to keep in mind about this NSA leak is that this probe would not have started when the story made it to the NYT. Most likely the investigation is over a year old and publication caught the cockroaches scrambling out of the light. Investigators were probably able to confirm their suspicions when that happened.
