In our constitution, you do have those rights. But if you choose to not play by the rules (i.e commit a felony) you loose those rights. But its by your choice of committing a felony that you loose those rights.
Not sure what your comment along the "Alienable" is all about.
Its the way it has always been and was intended by the discussions at the time of the writing of the constitution.
