UNDATED -- There's a lot riding on a decision expected from a Texas judge by Tuesday in Austin in the case of Texas Congressman Tom Delay.
The decision by Senior Judge Pat Priest of San Antonio could force the Sugar Land Republican to stand trial on conspiracy and money-laundering charges. It could also decide the future of the House Republican leadership and further shake a GOP hit hard by recent scandal.
The latest bad news came a week ago, when eight-term Representative Randy "Duke" Cunningham of California resigned after admitting he took bribes.
Since the September indictment that required him to step down as House majority leader, DeLay has cast himself as the victim of a political vendetta. He has pushed for the case to be resolved before January, when Congress reconvenes, so he can quickly return to his leadership post.

Perhaps the judge is protecting other dems by making this go away instead of Tom forcing them to produce "the evidence."

One question is whether the Judge threw them out with prejudice, or simply required The Earle to replead.
