We can hope that Roberts, and Alito (if he wins) will be sane. And maybe, if luck holds out, one more. But something is dreadfully wrong if the entire fate of the country rests with the SCOTUS. That's not the way the founders planned it.
I'm coming to the conclusion that when Congresscritters get elected most of them (or a great many of them) turn rotten, even if they weren't rotten to begin with.

What I'm thinking/feeling I won't say. Don't want to have my comment removed.
But you can imagine!
I based my early call on a comparison of the percentage split on the early vote to the percentage vote on the total vote. In those cases, the margin while starting close and remaining close at that point were getting larger. Thus there was no indication that the race was getting tighter.
It isn't a foolproof system, but in this case it seems to have worked. With over 90 % in now, everything went as I called it earlier this evening. Only 5 (commercial interest rates) and 9 (6 year terms for the regional mobility commissioners) failed.

That's how out of touch the Houston Chronicle is, and they wonder why their circulation is declining.
However, true to form, their op-ed section today features a hometown attack on Republicans, an anti-Bush hometown cartoon, and columns exclusively written by liberals. Not a single conservative voice in that section.

The gal on the channel 11 news in Houston along with a couple of reporters looked as if they'd rather die than report the results of the votes on prop 2. No enthusiasm about it at all. ;-)
It was never intended that the Judiciary have as much power as they have usurped and given themselves, but when the other two, allegedly coequal branches do nothing but bend over and accept it, its no surprise that judicial independence has become judicial supremacy. That's why we wait with bated breath to see which issues our judge-kings will let us rubes decide for ourselves, and which they'll impose a leftwing mandate on the entire nation.
Even if Bush hasn't continued in the long and sad tradition of awful Republican nominations with Roberts and Alito, and even if both turn out to be as we hoped and Bush promised, then the High Court as it is now comprised, and as it will be once Alito replaces O'Connor, would likely vote to impose at least civil unions on the entire nation, which would of course differ little in substance from an outright imposition of gay marriage, and would go against clear rejections of these euphemistic substitutes for marriage like Prop 2. I of course base this on O'Connor and Kennedy; while it wouldn't surprise me if they went along with an imposition of gay marriage, part of me suspects that they might try to assuage the anger of the American people by going with an alleged compromise with 'civil unions.' Of course, a judicial imposition of anything is no compromise at all, but it is true that many Americans hold the bizarre, contradictory 'gay marriage-no, civil unions-yes' view, and I could see O'Connor and/or Kennedy going for such a ruling.
But as far as I know, there are no cases dealing with this issue scheduled to go before the Imperial Court anytime soon, so O'Connor will not have a say in it when it does come. That means it all hangs on Kennedy (again, assuming Roberts and Alito turn out good), and I don't think there is much in his recent jurisprudence to base much hope on, especially considering Lawrence vs Texas.
Hopefully, the matter won't make it to the Sup Court until after a liberal retires, and hopefully either Stevens or Ginsburg (its too much to hope for both) will retire before at least early 2008. If Bush could replace one of them with a good judge, then good jurisprudence and fidelity to the Constitution would not depend on Kennedy.
Holding the line, or better yet, increasing the GOP senate majority would go a long way in furthering this noble goal, because it would embolden Bush to pick conservatives, enhance their chances of confirmation, and might just dishearten and depress Stevens, and convince him not to try and hang on to see if Hillary wins in 08.
Well said, and I agree... just not sure about Roberts and Alito. All I know is what I read on FR, and I don't have time nor the brains to read and understand everything that appears.
You sound very knowledgeable. What do you think about Roberts and Alito? I'd be glad to read your opinion. And your points about the Royal Judiciary are very true. What on earth happened to grant them this devastating power? Is it just because the other two branches have abdicated?
To tell you the truth, at this point I have little hope for our republic. The only thing that will save it is some unforseen circumstance/s. If things go on as they have been, I see only ruin ahead.
