Why hasn't Scott already filed a divorce from that horrible woman? Is he unable to sign the papers?

I think, if I remember reading it correctly, that Scott has been declared incapacitated. I don't think the judge thinks he's capable of taking care of his own business.
I don't think the judge will even listen to Scott testify in court to save his life.

That's a good point. Perhaps, that's the next step when they/courts acknowledge, even though he has brain injury, he is capable of 'thought/desire'. Silly, I know. Just like Terri, she would want to be married to a guy who went against their marriage vows, "in sickness and in health, till death do we part"? He went way over that - he not only had a relationship, he had 2 children, as you know. So, it's a slam dunk, she would have wanted a divorce. In effect, their marriage was dissolved, just not "official".
Not sure if he can sign the papers because right now there may not be any papers. Its a one step at a time situation because he has to prove it's his will.
