Doesn't automatically preclude confirmation. Ruth Bader Ginsburg was never a judge only the lead attorney for the ACLU. She got 93 out of 100 confirmation votes. But I agree this is a B-A-D choice for the nation. I shudder to think what will happen to the 2nd Amendment as a result of this.
But it also means that we don't know anything about her next votes as Associate Justice!
