Hell, I know what the Constitution says. I know as well as anyone that only martial law, declared in accord with the US and Louisiana constitutions, can trump the Bill of Rights for American citizens. That, or taking up arms against the government, which I do NOT, EVER say that this citizens in their homes are doing.
John
It just seemed to me you were confident that this was a legal action, when in fact there is no proof that Martial Law is in effect, or even if it could be used.
I probably read more into your post than was there. If so, I apologize.
John, I have a lot of respect for you and your opinions on FR. I think a lot of us are upset that you are not out in front of this. Had you said "I don't know for sure, but I'm finding out; and if this is illegal I'm on my way to court" We would be more reassured about your position. Currently, you seem just a bit lukewarm, here.
But isn't the problem that after 200 years of deterioration, the current court system is rife with people that think the government should be able to just make a declaration and then all of our rights are gone?
"TOday I am declaring 'no-poop day', and therefore anybody caught relieving themselves will be shot on site".
Curfews are legal. Forcibly removing people from their own houses, without warrant, even for "their own safety" is never legal, even if you can find a crop of modernist judges who think that the words "martial law" trump the constitution.
If nothing else, this may give pause to those who might otherwise think the law against federal troops doing law enforcement is just a quant anacronism.
