MONTREAL (AFP) - The Supreme Court of Canada acquitted a young man who unwittingly sold instructions on how to make bombs on the Internet, ruling that he had not committed an offence.
In a 6-3 decision, the court ruled that the accused did not intend to teach anyone how to build a bomb or commit a crime when he sent computer files to others that contained the hidden instructions.
But it also noted that a person could be found guilty in a similar case if the accused is conscious of the potential risks that stem from his or her actions.
Rene Hamilton, 23, used the Internet to market software that he had himself purchased online to more than 300 people that purported to enable the purchaser to generate "valid" credit card numbers. But the computer files also contained instructions on how to make a bomb and how to break into a house.
Hamilton claimed that he never used the credit card numbers and did not open the files on how to fabricate a bomb.
A trial judge acquitted him, citing the fact that no crime had been committed after he sent the information to others and believing that he did not intend for the recipients to commit a crime.
That decision was upheld by the Supreme Court, but the justices did not believe Hamilton when he said he did not plan to use the credit card information and so asked that he be retried on those charges.
I agree with the ruling, but for different reasons. Anyone that can't figure out how to make a pipe bomb has serious problems. The directions are in the name--get a pipe, make it into a bomb.
I dunno.
Maybe we better see the instructions he sold -- just to be sure.

It's obvious this kid is faux revolutionary punk and criminal. He is not just a dummy. The credit card scam proves that. At the least, he's a nerdy geek who thinks he's cool. At least he went to trial. He won't have any excuses next time!
