The ordeal is finally over, but for the past year, a North Carolina family has been torn apart after state officials claimed family photos of a father kissing his baby's belly button were some kind of child abuse.
It began when Teresa Hamaty took impromptu party snapshots of her husband, Charbel, playfully embracing their naked, newborn son, Kristoff.
After dropping the film off at an Eckerd store in North Raleigh, authorities were notified.
"You see the back of the baby, and like if someone is kissing the baby's belly button," Teresa told WRAL-TV.
But police saw the worst and arrested Teresa for taking sexually explicit photos, charged her husband with felony sexual assault, and put Kristoff and his half-sister in protective custody.
"It was a nightmare," Charbel said, after spending half a year in jail.
Teresa took months fighting to gain back custody of her children.
"I think this was one of those times that they got the wrong people," Teresa said. "They were too quick to judge when they took one look at my husband."
Dozens of Hamaty supporters showed up for court appearances, claiming police overreacted. They raised some $140,000 in legal and living expenses for the Hamatys.
"[It] makes me feel, that's it that's why I have to be strong for to show everybody what the truth is," Charbel told the station.
The charges eventually were dropped when a report submitted by an expert said there was no criminal intent in the pictures.
"I hate cameras," Charbel now says. "I don't like taking pictures."
I have pictures of my son bathing. He loved being in about an inch of water in the tub and he would flail his arms and legs. Biggest smile on his face. Also have pictures of him climbing into the kitchen sink to "help" with dishes.
What's really funny is I had to go back and read your post to see what you typed wrong. I didn't read "goy" I read "boy". Never even noticed the misspelling until you pointed it out.

Yesterday, my husband and I were going through all of our photo albums, albums that we made up about our children, and also the old photo albums that my mom and dad made up about me and my brother...
As I looking through these albums, I could not help but notice how many shots were of our boys, naked, either in the bathtub, or on their changing table...those cute little chubby baby bodies are just so adorable, especially if those cute little babes are your own...and I also found pics taken of both me and my husband giving little kisses to our boys on their bare tummies...nothing indecent, or nasty or wrong with that....and indeed, the babies loved it and laughed with delight...
Of course, some of those pics are more than 35yrs old...I suppose if those shots were being developped in a store today, me and the hubby might be in jail...thats sad...
The least he can do is bill them for six months at, say, $70 an hour.
When I saw the picture of the couple I thought maybe she meant he looked mid-eastern, as in Moslem.
Right after 9/11 there were some mid-easterners in the Raleigh area, they were Lebanese Christians if I recall correctly, who claimed their restaurant business was suffering because people thought they were Moslem.

Boy you know that pissed the officials off! One of their favorite tactics is run out your resources till you can't afford to defend yourself.
You got to know they kept him behind bars so long to keep him from earning any income.
Back when I was married, the stepkids father brought them home from his weekend visitation and we found some unusual bruising on the oldest (she was 7 at the time). There was an adult sized handprint bruise on her upper right arm, and a flat bruise across her bottom. She told us that her stepmother (her dad's wife) had gotten mad, picked her up by the arm, and threw her into the wall.
We took her to the base hospital, where she repeated the story, and the MD determined that the bruising was at least 12 hours but no more than 24 hours old - all corresponding to when she was at their house.
I ended up under military arrest, until the SPs showed up, listened to the timeline, and pointed out, just like I had, that the child had not been at our house at the time.
Vegas Metro got involved, and then their highly efficient (/sarcasm) DHS came and investigated our household..not the abusive household.
Go figure.
Yep if that is child abuse send me away now. My little ones love rasberries and the insides of their legs are VERY ticklish. Yup better throw away the key on me I probably 'abuse' my kids daily.
I though all SOBs had to be vaccinated against rabies. Stick him in a quarantine kennel for 14 days.

Speaking of child services, Last week i took my 4 yr old to get her vaccines caught up for school, they were a little late. I get home and a few hours later child services is at my door for child neglect, You cant even begin to imagine the shock i felt .... Charge was "medical Neglect" for late vaccines.. She asked me 700000000000 questions talked to my kids toured my house blah blah... Well thankfully she didnt seem to concerned.. But to me it was very insulting i adore my kids and take very good care of them . Just had so many things happen didnt get her shots in time wow.... well next time i know

Photos of man with infant lead to charges RALEIGH -- A Lebanese immigrant facing sexual assault charges involving his infant son is caught in the middle of a culture clash between Western law and Eastern tradition. The Wake County courts will have to settle the question: Is the 24-year-old North Raleigh man a sex offender or an affectionate father? Raleigh police have accused Charbel "Charlie" Hamaty, 24, of 5835-A Pointer Drive of first-degree sexual offense based on photographs of himself and his 6-year-old daughter kissing his 2-month-old son's groin area. An Eckerd Drug employee contacted police after two of the photographs were developed there, and a search of Hamaty's home turned up a handful more. If convicted of the most serious offense, Hamaty faces life in prison. His daughter and son have been removed from the home and taken into the custody of a local social service agency. The depiction of Hamaty as a criminal is disputed by both his lawyers and the more than 100 supporters who crammed a Wake courtroom twice this week for hearings related to the charges against Hamaty and his wife, Teresa. The supporters, mainly from the local Lebanese community, wore red ribbons that said "Support the Hamatys." They said the charges are the result of a misinterpretation of a half-dozen photographs among more than 100 snapshots. "We understand why the police did this, but there are innocent explanations for all of this," said Raleigh lawyer Daniel Boyce. Boyce has received offers of support from the World Lebanese Cultural Union, the Lebanese embassy and the American-Arab Anti-Discrimination Committee, based in Washington. "We're afraid there might be some cultural misunderstanding," said Kareem Shora, the committee's director of legal policy. Such kisses are signs of affection, not sexual abuse, ruled the Maine Supreme Court in 1996 when it overturned a sexual assault conviction of an Afghan immigrant who was similarly photographed with his 18-month-old son. The court ruled that the father kissing his son's penis was a common cultural practice and not a sexual act. "Kissing a young son on every part of his body is considered a sign only of love and affection for the child," the court said in its ruling. "There is nothing sexual about this practice." "It shouldn't be looked at as a crime," said Ludwig Adamec, a professor emeritus of Middle East history at the University of Arizona's Center for Near Eastern Studies, who testified as an expert in the Maine case. Hamaty, who works delivering pizza and three other jobs to support his family, is charged with first-degree forcible sex offense and two counts of sexual exploitation of a minor. His 34-year-old wife, who works as a nurse, is charged with two counts of first-degree sexual exploitation of a minor. That the Hamatys took the photos to the drug store proves their innocence to the Rev. Claude Franklin of the St. Sharbel Maronite Mission, where the Hamatys' relatives attend church. "If you're going to do something illegal, you would use a digital camera and put them on the Internet," Franklin said. "If you were doing something criminal, you wouldn't take the photos to Eckerd Drug." On Thursday during a bond hearing, Boyce said the photos have been taken out of context. Plus, Boyce said, police found no child pornography in the couple's home and no Internet access. In support of reducing Hamaty's $500,000 bail, Boyce argued that Hamaty's release would pose no risk to the community, his children, the witnesses or evidence. However, Assistant Wake District Attorney Jacquie Brewer argued that federal immigration officials have sought to detain Hamaty for potential deportation because his work visa has expired and he has failed to register with federal authorities as post-Sept. 11, 2001, laws require. Boyce said Hamaty had hired an immigration lawyer more than a year ago to resolve a dispute with federal officials since he believes his status has changed by marrying his wife, who is a U.S. citizen. Wake District Court Judge Paul Gessner agreed to reduce the bail to $250,000 and allow electronic house arrest with a number of conditions. While out on bond, Hamaty cannot be alone with any children under the age of 16, must surrender all photographic and video equipment and can have no contact with his children or the witnesses. Gessner also ordered Hamaty to cooperate with social workers in their investigation of the incidents. As of Friday, Hamaty was still being held at the Wake County Detention Center. The doctrine of Parens Patriae (King owns all children in the nation--from old British Law and wrongfully applied here) was strengthened to take kids from their dads in divorces. Now all parents will reap the benefits.
