"Let's say with this confirmation, Roe v. Wade comes before the SCOTUS before '08, and it is stricken. Abortion then goes back to the several States. Now let's say that somehow, Condi does indeed win the GOP nomination for President for 2008. What would be the gripe against her then?"

It would be like asking a Presidential candidate about gambling (i.e. a state's right issue)...something that isn't even bothered with in a national campaign.

Right now, it matters at the national level due to the ridiculousness of the SCOTUS back in 1973...but with Roe v Wade overturned, the pro-life battle would return to being fought at the state level, where it should have been all along.

With one caveat...no way could Rice be perceived as being capable of picking a pro-abortion SCOTUS nominee (if she wants to win).

Now, that being said...it's not going to work out like the above (I was simply answering your question directly). The *reality* is more likely that it will take two, possibly 3 Bush picks to the SCOTUS before Roe v Wade is taken up and overturned by a large vote. Remember that the 1973 RvW decision was 5-4. The vote that overturns it will be 6-3 or 7-2...making it clear that the new position will stand for a longer period of time than the initial Roe v Wade decision.

Likewise, Condi hasn't held an elected office yet...so she's really only in the running for our VP nomination (along with a very strong list, by the way). 4 to 8 years as VP and *then* she'll be Presidential material...though I must say, even with all of the above, I'd like to see her be pro-life anyway.

Remember that the 1973 RvW decision was 5-4.

Roe v. Wade was 7-2. Rehnquist and Byron "Whizzer" White (a Kennedy Dem) were the dissenters.
