Leading Senate Judiciary Democrat Charles Schumer said Sunday that he intends to make gay marriage an issue in the upcoming confirmation battle over President Bush's pick to replace retiring Supreme Court Justice Sandra Day O'Connor.
"All questions are legitimate," Schumer told ABC's "This Week." "What is your view on Roe vs. Wade? What is your view on gay marriage?"
"They are going to try to get away with the idea that we're not going to know their views," Schumer complained. "But that's not going to work."
The top Democrat's mention of same-sex marriage in the same breath as his party's primary litmus test issue, abortion, raised a few eyebrows.
"How does he suddenly have the chutzpah to ask that as a litmus question when he himself opposes it?" WABC Radio host Curtis Sliwa wondered Tuesday morning.
Schumer came out against gay marriage in 2004, after New Paltz, N.Y., Mayor Jason West performed nearly two-dozen same-sex unions.
As a congressman in 1996, Schumer voted for the Defense of Marriage Act, which authorizes states not to recognize same-sex unions from other jurisdictions.

What business does Schumer have asking nominees whether they are married let alone whether they are gay!
so schumer has just made it official:
it is the Democrat "gay" Party.
A judicial candidate cannot sit before these pompous asses and give his opinion on any of it. He/She will be expected to rule by law impartially. The elitists trying to corner the candidates on beliefs and thoughts could disqualify him from certain cases in the future. There are plenty of ways to conduct a respectful intelligent hearing for any person
named by the President of the United States. The slanderous jihadists need a lesson in manners and obligations to the citizens of America. Grandstanding will be done by the political egotists needing to read about themselves in the media. It is a sickness.
In a time of war, in a time of terrorism, in a time of budget battles -- leave it to the Dems to make "gay marriage" their top priority.
What the Dems don't wish to acknowledged is that when this was a referendum last year in the election, all states voted down gay marriage. Including two that went for Kerry.
It's a losing issue for them in just about every state in the union, not just "red" states.
remember part of their base is comprised of remnants of the blue collar union workers that used to be their main, as well as minorities. Both are solidly opposed to this agenda.
Schumer always has looked, sounded and acted, extremely light in the loafers, but until that homosexual marriage statement I just thought he was a sissy.

It doesn't suprise me at all! It's mainly Christian voters that sent any of the 14 Senators who voted against the 1996 DOMA and most of them are still there.
