What can he do if the Senate Judiciary Committee stalls & balks & delays the appointments to go to the full Senate as they are doing every appointment nominated by President Bush? FDR tried to increase the number of Justices because of their bad decisions, but he failed to do that. Can Congress over-ride a bad decision with a 2/3 vote like they can a Presidential veto??

Don't count on it. Any conservative nominee will result in an "extrordinary circumstance." I predict a vacant seat until Hillary Clinton nominates a liberal justice and the Republican controlled Senate votes the liberal in.
