Is law enforcement able to retrieve Instant Messages?

I would think that they would. If e-mails can be retrieved I would thing instant messages would be also.

It is my understanding that the hosting IM company (AOL, Yahoo, MSN, etc.) keeps the IM's for a period of about 3 years. LE would then subpoena the host to retrieve the IM's.
