I believe he had to be in the chair at the start of the vote. He is only needed if there is a tie vote. So I presume that they KNOW they have the votes without him.


I haven't seen a single republican express any reservations about Justice Brown, so I doubt any of them will vote no. Just as none of them voted against Owens (Stevens withdrew his vote to "cancel out" a missing democrat senator, so the final totals for both yea and nea on her were one less than they would have been).
