No punishement for the DEMs if they vote. They decide to vote or not. If they vote, they don't get spanked. If they don't vote, they do get spanked. The choice is in THEIR hands. That is my read on what is going on here. Frist wants the cloture vote on Owens to force everyone to show their hand. That is really all the "deal" accomplished. The Dems have to let nominations move now, or; 1) They will show they were not genuine in the promises, moving Frist's fence sitters back on his side of the aisle, 2) Frist will spank them with the nuke.

Fist (and I mean that more in the sexual sense than the combative) has demonstrated weakness, but keeping the egos of the Senate "in line" is probably beyond the realm of the possible.
It would seem that a strategy now would be to attempt to push through as many nominees as possible right now so the rats have to call "extraordinary circumstances" before everyone forgets that it was all about this deal so it's exposed as the political ploy that it is. That wasn't phrased well, I'm sorry, hope you got the gist.

Frist can simply refuse to move on to any other business until votes on ALL of the nominees are taken. If that means the Senate is in session continuously until the Government runs out of money on October 1, so be it.
