Look, when this "deal" was announced yesterday it was stated the nuke option remained viable. Many of us tried to explain that but many others were too upset to listen. They wanted to listen to Reid say yesterday the same thing--that it was off the table.
Reid was wrong yesterday and he's wrong today, as now is unambiguously plain.

What this site needs is for the guy who did the Iraqi deck of cards to start a similar list of the 10 filibustered appeals court nominees. Here is what I think the list would look like today:
1. Estrada Withdrew
2. Owens, Confirmed
3. Pickering, Recess appointed which expired in Jan 2005
4. Kuhl, Withdrew
5. Brown, Filibustered and renominated
6. Prior, Filibustered and renominated
7. Meyers, Filibustered and pending
8. Saad, Filibustered and renominated
9. Griffin, Filibustered and rennominated
10. Kavanaugh, Filibustered and renominated
11. McKeague, Filibustered and renominated
12. Hayes, Filibustered and renominated
13. Griffith, Filibusterd and renominated
So it seems to me we are talking about at least 13 Judges who were appointed and have not been confirmed or denied. So far we have gotten ONE. I have heard Graham today promise us an up or down vote on each of these nominees although he indicated Saad would not have the votes to be confirmed. [He did not say his name.]
Let's keep score. Are there any other Judge out there that I am missing? And Bush needs to reappoint Estrada, Kuhl and Pickering.

McCain may think he outmanuvered the President but my guess is that the President is going to hit him when McMaverick doesn't see it coming. he thought the South carolina primaries were rough? BTW.. the Dems will screw up their end of the deal..guaranteed...it's what they do...they screwed up the Wellstone Memorial service..it may well have cost them a few senate seats in 2000....
I understand the points and agree with the analysis regarding the votes. Although I do have to wonder if McCain and Graham had worked as hard to convince their own party to vote for various nominees as they worked for the compromise, perhaps things would have been different.
I'm also not pleased that some of the nominees still will not get an up or down vote. Frist says he will submit their names, and then perhaps we'll see where we really are.
You were much more calm about the entire compromise than I was at lunch :-) And time may well prove that your analysis was more seasoned, but at this point, I still have grave concerns that we have ceded control to the Democrats when we didn't need to.
Imagine a Democatic president and Senate. Imagine them signing this agreement which tells the Democratic president he has to confer with a minority Republican Senate before making nominations. Are you laughing hysterically yet? LOL
Anyway, it was great analysis with regard to the votes in particular and how that all played out.

Graham was trying to sell a contaminated bit of goods that he was actually a "yes" vote! If he was a yes vote why did he sign that blood agreement!
The fool actually thought he could get on the radio, smooth talk his way out of this. To hannity's credit he NAILED Graham. he struck him cold when Graham said they didn't have the votes...and hannity rebutted they had the votes beofre Graham DeWine and the rest signed on to this! Lindsey was struck dumb. I have a feeling that;s a usual state of mind for him.

If prolife is your only issue, true, you may be disappointed. If you want a justice who is not activist, but simply looks to the Constitution as it was written, then you may be pleased with the results.
Lots of downside
The issue was the downside to the agreement. Please tell me what downside exists that did not pre-date the agreement.
I've even seen diehard McCain apologists toss him overboard this week. Mccain made enemies that will enjoy frying him alive in the '08 primaries.
