I don't expect them to. I want to start by getting ten judges confirmed and if we can do that without risking the downside I think that makes sense. If they go back on it we can always try to change the rules at that time.

For those of us still cube-bound, what is it we have actually lost? I'm following some comments on this thread that say we get Owens, Brown, and Pryor; that the Dems could take up another filibuster on later nominees, but that the GOP could push the nuke button. What have we lost?

Or, rather, we get Owen, Brown, and Pryor, and then the Dems will take up the filibuster again, charging "extradinary circumstances," with the hope that because they let three through, they'll regain the PR advantage and this time make the filibuster stick. That's how I'm reading it. I think you are absolutely right. The dems traded three nominees for a potentially more favorable PR climate in a future fight. If Frist is a smart tactician, he'll keep moving the others through quickly so as not to give the dems an opportunity to make up their usual fiction about what has just happened.

So long as that's true I might not be quite as disgusted.... but then it just postpones the real battle to another day, for the Demagogic Party defines "extraordinary circumstances" as any judicial nominee who they see as a threat to their castle of judicial fabulism and anti-constitutional inventions....
