I'll ask a stoopit question: why are they scheduled to go through the overnight? It's by unanimous consent of the leadership. So, the only reason I can think of is that both sides believe the matter is important enough that it warrants drawing public attention to it.

Rat Leahy knows the Republicans have the votes and is grasping straws in finding some peal away votes. He just requested the Majority Leader announce that all should vote their conscience but obviously the Rats have no conscience or they would vote up or down.
