Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.
Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.
On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.

Yes. Schedules will alternate. This is currently the Reps hour. Frist suggested this could be a late night in opening remarks.
Someone on the thread relayed info from the news that cots were being brought into Thurmond's room. Any guess as to what that means.

Roberts- sentiment that restoring Senate precedure is reactionary. Blocking nominees hallowed traditions. History denies that argument.

Hmmmm... there are a couple of good arguments for McPain to vote with the demonRATS! Either: (1)We won't have to worry about him in 08 or (2)We'll have the votes for the Constitutional option! It's more likely a win-win for us, however the fool votes.

"In Tuesday's vote, the key will be how many Democrats decide to join the 55 Republican senators in voting for the cloture motion. Under the current rules of the Senate, it takes 60 senators to vote to end debate.
If Frist does not win the cloture vote, he would seek a ruling of the presiding officer that further debate was dilatory. If the Senate sustained such a ruling by majority vote, then the filibuster-ending threshold would be lowered from 60 to 51. "
IOW, the Dems could still vote for cloture and avoid the change in filibuster rules for nominees.

Roberts likens the dims to a toddler throwing a temper tantrum in the market. This is not about great senate traditions or cooling passions of the day, or about doing away with the filibuster or about Jimmy Stewart and Mr. Smith Goes to Washington, not about unnacceptable judicial nominiees, but about a new procedure that is denying senators their right and duty to vote.

Graham joins gang of 12 in their effort to save the republic
FREEDOM of speech is being exercised, Sen. Lindsey Graham said Friday. Theyre calling in to the office and yelling and screaming, and they dont quite understand whats going on.
He was speaking of the professional polarizers who staff the Washington interest groups that have the U.S. Senate in a death grip over judicial nominations.
Sen. Graham is getting particular heat because hes one of the gang of 12 who have been trying to negotiate a way out before the crucial vote Tuesday on the nuclear option a GOP move to end filibusters of judicial nominees with a simple majority.

Mr. Graham plays a critical role because he and Mike DeWine of Ohio are the only two real yes votes in the bunch. In other words, they will vote to end judicial filibusters if a sensible deal is not worked out. Without them, its just a bunch of people who plan to vote no anyway negotiating among themselves.
