When in the h3ll did it become ok to sue people even after everything points to utter stupidity as the cause? This Rabbi needs to accept the fact he bred an imbocile and move on, and the lawyers publically flogged in front of the courthouse doors.

SANTA CLAUS, Ind.

LOL. So appropriate given what this lawsuit-happy dad is trying to pull.

When the first lawyer was vomited up from Hell itself.

If the case is going to be about woulda, coulda, shoulda, the how about the parent's responsibility to teach the child to heed warnings? I'll bet they never made her buckle up in the family auto, either.

This is a local, family owned amusement park. Some moron decides to do something suicidal and the family expects somebody to pay for it. I wish some judges would grow some ____ and start awarding damages to the defendants in these kinds of cases. In my opinion the park was financially damaged by the publicity from the death. The woman's estate should cover that cost.

We have a society that needs to blame someone (anyone) else and never admit personal responsibility. That is compounded in this case by the fact that her father suffered a terrible loss and doesn't want to see his daughter's fault so he's going to blame anyone he can.

Fellner, 32, of New York City

A 32-year-old who stands up on amusement park rides?

I fail to see what more they could have done to prevent this idiot from undoing her safety belt and standing up, short of chaining her to the seat and locking it.

But they couldn't do that, because being locked into your seat, unable to release it in case of a different kind of accident, would be a much worse safety hazard.

Ergo, there was nothing more they could possibly be expected to do in this case.

Officials concluded that she stood up while the ride was moving.

"Hey, watch this!"

32 year old Tamar Fellmer discovers that not only is there a Santa Claus in Indiana. There is also "Gravity". Can the amusement company sue the Fellners for just being stupid?
I suppose the only good thing to come of this is Ms Fellner landed on a guy from Wendy's who was missing a part of his finger.

If I were the amusement park owner, I would have filed suit against her estate three days after the funeral. I mean it. I have thought about this kind of crap for a long time. That dumb 32 year old adult woman endangered everyone when she decided to become a projectile.

In Washington state, a man sued a lawn mower manufacturer for not warning him about the danger of reaching under it when it was running. Fortunately, he lost.

But the lawsuit filed Monday on behalf of Fellner's father, Rabbi Azriel Fellner, alleges the amusement park failed to ensure the woman was properly restrained and that the manufacturer could have used a safer design.

Sorry, rabbi, but padlocking everyone in their seat becasuse some people are stupid (genetically or otherwise) is not an option.

About the time parents were allowed to sue when adult children, who have no financial tie to the parent, die.

Honestly, what are this man's tangible losses? If we are going to allow emotional distress than we will all be able to sue American Airlines for "allowing" their planes to be used in terrorist attacks. After all, we were all traumatized, and surely they could have done something, like welding the cabin doors shut or something.

They need a sign out front that reads "If your IQ doesn't reach this line, then you're too stupid to ride on this roller coaster."

Vonderahe said the fall was an accident, but a preventable one.

You can't stop people from being stupid, Mr Vonderahe. I don't think I have ever, EVER thought of unbuckling a seatbelt and standing up on a roller coaster.

It was preventable; the father could have kept his kid off the ride.

Sheesh

They sure could have. Mandatory IQ test before being seated.

Sorry about the loss of your daughter, Rabbi. But she is the only one at fault. Stop trying to make some easy cash (paid by those of us who carry insurance policies through higher premiums) from her demise.
