"by retreating to the Constitution group think is sure to win"

Sorry but I have no idea what you are talking about. It is the constitution that guarantees our freedom by binding and limiting government (b/c government growth is antithetical to individual freedom). While true our constitution is rooted in moral principles, your claim that it leads to group think is absurd.

Furthermore our adherence to the constitution has no relationship to the advancement of socialism in our society (in fact being a government limiting document is has been one of the greatest impediments). Socialism has advanced because enough people believe in it and actively campaign for it and gained enough prominent positions during the 20th century to advance the ideology.

If the majority of the founding fathers thought our underlying principles should guard our freedoms then what the hell did they write a constitution for? Honestly now.

They wrote a Constitution to provide and administrative framework and limit the power of govt. There was debate as to whether or not the Bill of Rights should have been included. The Constitution doesn't grant an individual his rights, God does that. The fears of Patrick Henry have been realized in America today, most Americans consider the Constitution as the source of their rights, and accept as their rights whatever the Supreme Court at the moment decides they are.

The Supreme Court can use whatever logic it wants to get around the Constitution and has many times.
