They wrote a Constitution to provide and administrative framework and limit the power of govt. There was debate as to whether or not the Bill of Rights should have been included. The Constitution doesn't grant an individual his rights, God does that. The fears of Patrick Henry have been realized in America today, most Americans consider the Constitution as the source of their rights, and accept as their rights whatever the Supreme Court at the moment decides they are.
The Supreme Court can use whatever logic it wants to get around the Constitution and has many times.

Your completely right, our rights do come from God. The constitution was created to secure those God-given rights. All humans have the inalienable right endowed by there creator yes, ALL humans including Muslims. No human has the right to treat others differently for a crime they didn't commit. If they are terrorists string up by their boot straps, but if they have nothing to do with terrorism, it is an error in judgment (and anti-Christian as well as anti-conservative) to suggest they are also murderers and terrorists. Jesus would never do this.
