TALLAHASSEE, Fla. (AP) -- The Florida Supreme Court says it won't consider an appeal from conservative commentator Rush Limbaugh. Today's four-to-three order didn't explain the court's reasoning.
Limbaugh's attorney argues that an appeals court misconstrued Florida law when it ruled prosecutors could review the records.
Prosecutors seized Limbaugh's medical records in 2003 for an investigation into whether he illegally purchased prescription painkillers.
Limbaugh hasn't been charged with any crime. He lost at the appellate court level and wanted the Florida Supreme Court to overturn a ruling that would open his medical records and possibly allow prosecutors to build a case against him.
Limbaugh has maintained his innocence throughout the investigation and argues that the case threatens the privacy rights of all Floridians.

But it likely have to be instigated by authorities. I think a civilian would have a bit more trouble than legal authorities.

Because x42 is a notorious cokehead If you have proof of this, you should pursue it. Get off of it. The whole world knew it. His brother even stated such. Just wish we could have left it at that.
You see, the way it works is you actually have to prove your accusations. Just "knowing" it isn't enough. After all, the Democrats said the same thing about Bush.

"I practiced psychiatry for over forty years. Never, not once, did I ever see a case where an iatrogenic addict was charged with any crime provided he or she had not committed some other crime such as theft, prescription forgery and so forth. "
Neither have I doctor. I think your having practiced medicine for 40 years, without having heard of this kind of prosecution is ample evidence that this is indeed selective prosecution.

But the Drug War has little to do with the consumption of drugs and everything to do with the Delivery, Transportation and Sale of Drugs.
So you're OK with free market trade in Oxycontin? What about Vicadin?

What is your problem with Rush?
Nothing at all. I'm a big fan of Rush. I guess it's difficult to conceive of someone being a fan and yet be willing to admit when someone they admire is wrong.

The differential diagnosis for cough probably includes at least DOZENS of possible causes, including asthma, reflux, cancer, pneumonia, etc. Out of just these 4 alone, only 1 would potentially be treated with antibiotics. Given the increasing problem with antibiotic-resistant infections, why would we want to take the chance on making antibiotics OTC?
I keep thinking, is this what it was like 100 years ago when people who fell ill managed to survive?
100 years ago, your chances of dying from any given illness was much greater than today; things aren't all that bad....

Have you ever treated someone with Rush's financial and social resources? He's clearly not your typical perp.

Not a right wing republican. But then again what credibility does his cokehead brother have. Flame away.

Because x42 is a notorious cokehead. If Rush is going to be harassed for popping painkillers, the same sauce ought to serve the goose, as it were.
Eno is a well known drug advocate. Ignore him until his hallucinogens kick in. His orderlies with bib and diaper him and he'll be fine till dinner.

I still think this had something to do with Marta.

They can identify Rush and take his medical records but the Kansas AG can't get anonymous medical records to prosecute illegal abortion procedures? What's wrong here? What's wrong is the Republicans in Congress that will not use their majority power to put through Bush's court nominations. The judiciary is a mess with activist political judges and the Republicans do not want to play politics.

"BTW, Mark Levin is one of his lawyers ..."
I believe Mark is a wanna-be Rush lawyer.
I think he stepped in it a while back when he filed an independant Florida Sunshine Law request that wound up causing the release of Rush's "plea bargaining" letters.

Then didn't he try to 'release the hounds' on the county prosecutor? And that backfired too.
