Police 'Showdown' Averted ['Team of State Agents Were En Route to Seize Terri']

Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted -- but they stopped short when local police told them they would enforce the judge's order, The Herald has learned.

Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.

For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called ``a showdown.''

In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.

''We told them that unless they had the judge with them when they came, they were not going to get in,'' said a source with the local police.

''The FDLE called to say they were en route to the scene,'' said an official with the city police who requested anonymity. ``When the sheriff's department and our department told them they could not enforce their order, they backed off.''

The incident,known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

I frankly think this response, as well as many others, are sad. What do you expect Jeb to do? The family was fighting in the courts. Jeb took it to the legislature, and the Senate failed to act. THERE IS ONLY SO MUCH THE CHIEF EXECUTIVE--in any state, Florida or wherever--can do. If he had seized her earlier, a court would have blocked it. Now, do i think he had that autority? Yes...but he would have used it ONLY if he knew he had the gbacking of at least the legislature--but he didn't even have that. They refused to simply pass a common sense law.

Jeb is A HERO IN THIS, despite the irrational emotions of some on here. It is truly sad the venom being speweed at someone who if it weren't for his work, Terri would have died long ago. Jeb has been Terri's #1 advocate--the parents' lawyer is an idiot (good guy, but an idiot).

I'm so sick of the anti-Jeb stuff. If you all don't want to support him if he runs, fine--but I find it sad. Who are you going to support then? Frist? Santorum? They would have done the same thing.

Sometimes people just lose all reasonable thought. Jeb did as much as he could POSSIBLY DO. It's sad, frustrating, etc, that some of yout hink he could have done more.

We shouldn't ignore the religious right--of which I am one. Let's be fair here. I'm on a couple list serves of the "religious right" and all agree with me that Jeb did what he could. It's the unreasonble "kooks" who actually think it would be a good idea to start a war--do you realize what that would have done? It's so easy for some of us to sit here and act like we're playing some computer war game where you can take back what you did, or just hit reload. Jeb OBVIOUSLY took the "seize Terri" option into consideration, but in the end, it was simply not worth it.

Jeb Bush previously requested legal advice from the Thomas More Law Center for an analysis as to his lawful gubernatorial options to assist and save Terri's life. The Thomas More Center resent that memo late last week because in its view of his authority as specified under Florida's constitution and statutory law, some options were still available. Gov. Bush is apparently ignoring that advice and claiming there's nothing he can do.

If nothing else, any governor has the power to grant a pardon and Florida's constitution on the subject is written in such a way that a pardon IS NOT linked to criminal matters. Pardons are time-honored and exclusive authority of top governmental executives. As such, they are irreproachable and untouchable by either judges or legislatures. Legislatures may and sometimes do grumble, but can do nothing. (Remember BJ Clinton's end of term pardons? Much complaining, but nothing could be done.)
In Florida, pardons do require concurrence from two cabinet members, so perhaps the concurrences weren't there. But Gov. Bush has been silent on that issue so there's no way to know whether Terri might have been saved. I would respect Gov. Bush more to know he did investigate all options. His silence on so critical an issue does not serve him politically and leaves the impression he's abandoned Terri and allowing an innocent individual to be executed by civil order. I hope you never find yourself in Terri's circumstances.

I've looked at what's in the law. My comments were based on understanding both Florida law and the factual background of what has transpired, not on what you claim are "irrational emotions".
Gov. Bush chose to announce that there's nothing he can do, which leaves an impression to the world that he's helpless. He chose those words and will have to accept the perceptions his words engender. You've apparently been relying on MSM reporting and your own emotionalism and political philosophy.

I believe that sometime close to when Terri collapsed, Michael started working in the medical field. I'm guessing it would have been relatively easy for him to get hold of insulin.
I've heard, but have not checked out, that insulin can be obtained without a prescription. Do you know if that's true.

Within the last two days I've been able to listen to an interview of one of Terri's early childhood to adulthood friends who spent a lot of time with Terri and her family and often shared meals with them. She was asked specifically if she had seen any signs of Terri being weight conscious (bulimic) and without hesitation, she said no. In fact, she observed that Terri had a healthy appetite and at that time weighed about 115 lbs.

Yes though it may depend on the state. In PA Insulin R and Insulin N are available without a prescription. In PA however It takes a prescription to get the syringe or needles. I believe some states do not require a script for those either.

It is a shame that so many of us do not trust the courts or the justice system to the point that we are having such a heated bitter debate. In some ways I feel this case shows just how much we do not have faith in the Government that is suppose to represent the best in the history of Humanity. I hope the courts have given all aspects due consideration and they may even have, but given such a tyrannical history of the Judiciary I believe it is appropriate for us to question whether justice has served Terri and ultimately everyone of us. My sincerest hope is that Terri's true wishes are being carried out and that government as was intended is there to protect the rights of the people. As a side note what bothers me tremendously at this time is MS supposed denial of Eucharist to Terri. If this is true shame, SHAME! on him and the courts, if this is true.

"If Jeb had sent in forces to hydrate Terri (which might have been a challenge -- whom was he going to bring to do the job if the hospice staff refused?), the Pinellas County Sheriff could say they were enforcing a court order that had already been through Federal court, the 11th Circuit Court of Appeals, and the SCOTUS and returned intact. What would Jeb have countered with? If Jeb had followed through on what he (and most of us) know is right, what kind of legal cover would he have had besides his own counsel's opinion of what his authority as Governor allowed?"

Many individuals and institutions bear responsibility for Terri Schindler's situation, Governor Bush and President Bush, imo, are not among them.

However, she not only lost the case at trial, but the trial error committed was the basis for the Schindlers to lose in every other court all the way to the U.S. Supreme Court. Once a case is tried and decision made on the merits, it is virtually impossible to have the decision reversed on appeal. Appellate courts review the merits of the case, not the credibility of the witness and thus when Greer ruled that Michael Schiavo’s self-serving hearsay testimony was credible that Terri would not want to be kept alive, the die was cast for a denial at every appellate level.

#13 - that's EXACTLY the way I feel about this situation. I have thought there should have been a massive citizen UPRISING long ago. We ALL knew where this was heading. This situation is so CRITICAL to what happens in the future, I'm completely shocked at the weakness of the people. There is POWER in numbers, a HUGE amount of people could have stormed that Murderous HELLHOLE and rescued this innocent woman. For crying out loud, you can't starve and dehydrate your pet to death. You'd be prosecuted by the ASPCA immediately. You would be in Canada also. You can't even starve and dehydrate and Serial Killer to death. NO, they have to be treated with kid gloves, kindless, RESPECT and all that crap!! I honestly NEVER thought I would witness such a thing happening to an innocent, vulnerable United States citizen.

Actually as a matter of Court record, Judge Greer made the following statement: "The law of THIS case, is that the girl is going to die"!! I don't know how much clearer this Judge's intentions could be made. He was DETERMINED that the outcome of this case was the death of Terri Schiavo. Greer, Felos and Schiavo and a number of others in the background, ALL are involved in the Hemlock Society and every other group that promotes KILLING off citizens that are let's say, "inconvenient useless eaters". I find it interesting that Judge Greer himself is LEGALLY BLIND. He is not even permitted to drive a car. I guess he had to have the legal briefs read to him then huh? In my books, that makes Judge Greer, imperfect and therefore DISABLED. His Starvation and Dehydration should be next!!

Terri S. was NOT looking to harming herself with dieting if that's what your referring to. What she WAS looking to was getting a divorce. She spoke of it the night before with her girlfriend who begged her stay overnight with her because Terri and Michael had been fighting most of that day. Instead, Terri went home and as we all know by morning she was on the floor unconscious. It is also a matter of record that MS called Terri's Father. He rushed over and called 911. Michael Schiavo was sitting on the couch reading a magazine. And Terri's subsequent bone scan showed multiple bone fractures throughout her body, all in different stages of healing. And according to Dr. Baden, there was clear evidence that she had suffered an attempted strangulation. Terri ought to be walking around and HINO OUGHT to be in Jail. This entire case has been more than a TRAVESTY and NOW we sit and WATCH the poor girl being starved and dehydrated to DEATH. Must finish the botched murder ya know. I am simply stunned that this case has turned out the way it has. A lot of people have dropped the ball but Jeb Bush has been the worst. He has EVERY RIGHT and all the AUTHORITY he needs to sign an executive order and take Terri, a disabled person in danger, into Protective Custody. He could have done it and SHOULD have done it, LONG AGO. Even NOW, he sits on his hands. ASTOUNDING!!

You should read the Florida Statutes. Jeb Bush has had and still has, ALL AUTHORITY he needs to take a disabled person, a child, or any vulnerable citizen, into Protective Custody under the DCF!! Terri Schiavo has OBVIOUSLY been disabled and vulnerable and in great danger.

What's clear is that the Governor is really NOT the Governor. Florida is RULED by a rogue, runaway, Judge or group of Judges. That is Not what your constitution ever intended.

Dear Friends of the Constitutional Republic,

Yesterday, I spoke to a good friend in Florida. My friend is also my business partner and we discussed business for a few minutes. But our hearts were both heavy with the public murder of Terri Schiavo. My partner said something that caught me short and took my breath away.

He said, "Well, at least Jeb Bush tried to do something. He tried to save her life."

I felt my blood rising.

No, I told my long time friend. Then I found myself saying it a little louder. "NO!" I repeated, "He did no such thing!" What infuriated me was the realization that they (the Bushes and the media pundits) had convinced my good friend that they tried to save her life. To the contrary, I rushed to explain to him, the actions and explanations of Jeb and George Bush are the thinnest sophistry and can not be viewed as credible to any sentient person.

There is no reason to believe Governor Bush or President Bush when they say that they tried to help Terri Schiavo. In fact, they are accomplices to murder.

And - make no mistake - this is murder. Murder most foul! Murder carried out in broad daylight by a judge, a police force, the Governor of Florida, and the President of the United States.

That's right. George Bush, against whom I ran for President, has murdered Terri Schiavo.

As I stated in my open letter to both Governor Bush and President Bush, they have not only the means and the ability to save her life, but the affirmative duty to do so.

Right now, they have hidden behind the thin veil that, as executives, they are subject to the opinions of judges which they call the "rule of law" when it's convenient for them to do so. But the opinions of a state or federal judge are not the rule of law. They are merely opinions.

The Governor of Florida, by his oath of office, has an affirmative duty to uphold the law and to protect innocent life in his jurisdiction regardless of what any judge says! Moreover, his police powers extend to the prevention of crimes, including murder. The well-publicized murder of Terri Schiavo is being carried out before him while he wrings his hands, expecting us to believe that he would stop it but he just can't.

The police do not work for the judicial branch of government. They work for the executive.

And does George W. Bush really expect us to believe that he can send our sons and daughters to all corners of the world fighting "terrorists" but he can't stop the terrorist act of public execution taking place in Florida? Five years ago, on Easter Sunday Morning, the U.S. Justice Department thought they had the authority to raid a Florida home to steal Elian Gonzales from his mother's family. So, why can't they steal Terri Schiavo from those who are killing her?

When I consider these things, I ask myself why these brothers, who claim to be Christian, would not use the authority and means at their disposal to stop this terror in America.

Could it be that both brothers, while elected to executive positions, realize that it's the unelected judiciary that advances the internationalist agenda that their father spoke about (the New World Order)? Don't many of their globalist initiatives depend on the fact that we believe, falsely, that "law" is a changing, dynamic thing, and that judges, as the agents of that change, can "make" law. Could it be that while the Bush brothers and their one worlder colleagues put up a fight against the United Nations or, in this case, against a state judge, that they really don't intend to win?

Could it all be a sham, start to finish? Could it be that they just want to look like they care about Terri Schiavo - or you - or me, or the Constitution, or America, but they don't?

When they have us thoroughly convinced that judges can make up law, even to the extent that they can murder our daughters in front of our eyes, then they can do anything they want. They will have their new order.

Our founders recognized that all law, and liberty and government come from God. They founded our country on the presupposition that Christ is Lord. He still is Lord. He always was and always will be. He is Risen and through His Resurrection we can face tomorrow with hope. He is Sovereign. Amen.

This is murder and the Bush brothers are accomplices.

Somebody has to say it.

I just called Mr. Hatches office. I had to call twice because I forgot to mention some things. There might be possible federal investigation but it is unknown because they weren't being very forthcoming. I left my name the second time. First time said about her being held in Hospice of the Florida Suncoast, Inc. for 5 years. She's not terminal and that she is on Medicaid. Second time to give my name and say Hospice is violating Americans with Disabilities Act in which expressly prohibits denying a substantially disabled patient in the United States of America nor permitting the authorization of any representative or Guardian of an individual with a disability “to decline food, water, medical treatment, or medical services for that individual” There was a different person the second time.. said he would relay it to the Senator but that he had to go.. basically cut me off so I couldn't read the Section numbers of the Code itself. (Title 42, U.S.C. Sections 12101 and Cf 28 CRF, Ch 1, Subpart B, Section 35.130).

There have been a number of postings today, regarding making your "own

flyer" that is very informative. Just as I had started the mass campaign to "CALL

DCF WITHOUT HESITATION" a few days ago (which seems to be posted a gazillion

places now too), I think we all need to gather our thoughts and work

together to create the right presentation.

We need to push the issues with both of the Bush brothers. Governor Bush

needs to assert his authority and power. President Bush needs to persuade the

congress and whatever other powers that be, to follow through with their

subpoenas, authority and pursuit of justice for Terri.

The mere fact that Terri is to appear before congress on Monday 28March2005

(tomorrow) means THAT subpoena must be executed. According to many statutes

and laws, as well as organizational policies and codes (such as the DCF and

other human protection agencies), the Governor CAN (and should) take Terri

into protective custody.

To date, however, he has ignored that. I truly believe that Governor Bush

wants to "do whatever [he] can" to save Terri. Unfortunately, he found the

proverbial Greer (brick) Wall when he tried.

However... (and here is where it takes that extra step, Folks) Governor Bush

or Federal Agents as ordered by Congress/President Bush MUST assert their

powers and enforce the subpoena. When Terri doesn't show up on Monday, TERRI

MUST BE ARRESTED! The Governor and DCF have a duty. The Governor, the

Florida Department of Children and Families (DCF), the President and the Congress

(both house and senate) MUST continue their plight to seek justice for Terri.

The congress and Governor Bush and President Bush and Seantor Bill Frist

MUST enforce the subpoenas and ISSUE A WARRANT FOR TERRI'S ARREST!! They know

just where Terri is. Go ARREST TERRI!

The state and federal laws, state and federal statutes and organization

policies and codes can easily be pursued and brought to life (so to speak).

When she doesn't "show up" for her subpoena tomorrow, Governor Bush (or

Senator Bill Frist, who is VERY gung-ho on applying the laws to "judge" Greer as

well as Schiavo and Felos) has repeatedly said that "no little judge" is

going to... SO!... Let's make sure he holds up to those statements!

So... print flyers - but keep it to the point. There is no need to go into

the HUGE number of injustices and one-sided horseshit that goes with this.

That will ALL come out when it's necessary. Right now, we have to concentrate

on getting Terri the help she most desperately needs.

Please print the flyers, but remember to keep your info short and sweet. In

your flyer, invite your friends and families to join the boards at yahoo and

visit Terri's site (_www.terrisfight.org_ (http://www.terrisfight.org) ) and

to PLEASE contact their reps and Governor Bush, and DCF and President Bush.

Points to remember and point out:

TELL THEM:

1. YOU KNOW OF A DISABLED WOMAN IN IMMINENT DANGER!

2. SHE IS BEING GROTESQUELY NEGLECTED.

3. SHE HAS NOT RECEIVED WATER SINCE FRIDAY 18 MAR 2005

4. HER NAME IS TERRI SCHINDLER SCHIAVO. (SPELL SCHIAVO)

5. YOU ARE "FRIENDS OF HER FAMILY"

6. SHE IS AT HOSPICE HOUSE~WOODSIDE / PINELLAS PARK, Florida

7. GIVE THEM YOUR FULL NAME AND PHONE NUMBER

8. TELL THEM YOU CAN ANY INFORMATION THEY MAY NEED

9. TERRI HAS BEEN SUBPOENED TO APPEAR BEFORE CONGRESS

10. TERRI IS BEING INTENTIONALLY DEHYDRATED TO CAUSE HER DEATH

AND, you believe wholeheartedly that SHE IS BEING PUT TO DEATH IN ORDER TO

PREVENT HER APPEARANCE BEFORE CONGRESS!

Although most of us could recite a mountain of reasons for them to pursue

this investigation, at this point, those things are "irrelevant." We must

pursue JUSTICE FOR TERRI, with the circumstances of RIGHT NOW. Later, we must

band together and pursue JUSTICE FOR SCHIAVO too, although I am sure ALL of us

want to see a whole different sort of of "justice" when it comes to that

sorry son of a bitch. (And I am sure that we will all stick together to make

that happen ~ LATER)

However, right NOW, we MUST pursue the Governor and President Bush. Rem

ember, they have both, in concert with the congress, PROMISED TO and went so far

as to CREATE LAWS in the middle of the night to PROTECT AND INSURE TERRI'S

RIGHTS! Now, let's make sure they live up to their promises.

Hospice... Bob & Mary Schindler have promised to protect Terri's rights.

Bobby and Suzanne and family have promised to protect Terri.

100's of supporters and Terri Warriors fight for Terri's

rights.

Florida... Governor Jeb Bush has promised to stand up for Terri's rights.

Congress... Senator Bill Frist has promised to stand up for Terri's rights.

 

House... Unanimously agreed to stand up for Terri's rights.

Senate... More than 2/3's agreed to stand up for Terri's rights.

Nation... President George Bush has promised to stand up for Terri's rights.

World... The POPE has been very unambiguous about Terri's rights.

We are not alone. We are all fighting for the same rights. Terris' rights!

Terri's needs! Terri's love and life and liberty!

PLEASE continue to contact the media, continue to contact the Florida DCF,

continue to contact the Governor. My suggestion is below. Please remember to

sign your FULL NAME, ADDRESS, CITY-STATE AND ZIP and add your phone number

if you wish.

Also, remember to send this "brainstorm" to the media as well. Thanks for

listening to the rambling. Please work hard and long on this issue, as time

is short for Terri.

Governor Bush,

I am writing to you today requesting that you assert your powers to protect

Terri Schindler Schiavo. As you well know, Terri (and others) have been

subpoened to appear before Congress on Monday 28March2005.

Most of the others sought to appear by this subpoena are seeking to prevent

Terri from appearing before congress. Terri should be required (by law) to

appear for this subpoena. Those people, namely Judge George Greer, attorney

George Felos and Terri's estranged husband Michael Schiavo have Terri confined

to a Hospice Room. She has been neglected, abused and exploited by these

men, in order to prevent her from appearing before Congress. Terri is being

starved and dehydrated to death by Mr. Schiavo and Mr. Felos and have sought

and acquired a judicial order by Mr. Greer to allow the starvation and

dehydration, with their exact intentional finality being Terri's death.

Please pursue the subpoena. Place an arrest warrant on Terri and GO GET HER

AND ARREST HER AND PROTECT HER FROM THIS TYRANNY!

Please do what's right, Sir. Terri's life depends on it.
