Police 'Showdown' Averted ['Team of State Agents Were En Route to Seize Terri']

Hours after a judge ordered that Terri Schiavo was not to be removed from her hospice, a team of state agents were en route to seize her and have her feeding tube reinserted -- but they stopped short when local police told them they would enforce the judge's order, The Herald has learned.

Agents of the Florida Department of Law Enforcement told police in Pinellas Park, the small town where Schiavo lies at Hospice Woodside, on Thursday that they were on the way to take her to a hospital to resume her feeding.

For a brief period, local police, who have officers at the hospice to keep protesters out, prepared for what sources called ``a showdown.''

In the end, the squad from the FDLE and the Department of Children & Families backed down, apparently concerned about confronting local police outside the hospice.

''We told them that unless they had the judge with them when they came, they were not going to get in,'' said a source with the local police.

''The FDLE called to say they were en route to the scene,'' said an official with the city police who requested anonymity. ``When the sheriff's department and our department told them they could not enforce their order, they backed off.''

The incident,known only to a few and related to The Herald by three different sources involved in Thursday's events, underscores the intense emotion and murky legal terrain that the Schiavo case has created. It also shows that agencies answering directly to Gov. Jeb Bush had planned to use a wrinkle in Florida law that would have allowed them to legally get around the judge's order. The exception in the law allows public agencies to freeze a judge's order whenever an agency appeals it.

You still got it wrong.

Mrs. Schiavo's side is not the one you stated. That's the Schindler's position. What proof do you have that she's on that side?

The courts and GALs have repeatedly examined this and concluded that Mrs. Schiavo and Mr. Schiavo's side is the same. You are the one with burden of proof to show otherwise.

WELL SAID.

There is a tendency to 'eat our own' when we fail to win in these heartbreaking cases... but that deflects focus from the real agents of Terri's death, specifically Judge Greer.

And BTW, I take Jeb Bush at his word that he wont run in 2008. So be it, he's a good man in a difficult situation right now.

All the courts have ruled on one judges, Greer determination of facts. They just reviewed if he applied the "LAw" Like I said before, a bunch of cruel NAZIS.

He better not run for POTUS in 2008. After the shameful display of cowardice he displayed in this incident, no one in their right mind would trust him to defend the USA from threats. Hillary would eat his breakfast, lunch and dinner!


I agree. Even Howard Dean would beat him at this point. Jeb there is still time do the right thing.

And the real quilty parties - the entire Judicial branch of Government, that was handed the opportunity to correct this and deliberately turned away so one of their own (Judge Greer) could judicially execute Terri Schiavo.

The people to blame in this are Judge Greer and every judge who touched this case and failed to save Terri or respect her true rights.

While this is true, the BLAME FALLS ON THE JUDICIARY.

The Federal judges ignored the plain intent and language of the recent bill to refuse the 'de novo' review that Congress and the President signed into law specificall to give Terri another chance. ... the 11th circuit appeals vote was 7-5 against.

Without that review or other judicial overturning of Judge Greer's order, THERE HAS BEEN AND IS NO LEGAL BASIS TO UNDERMINE JUDGE GREER'S DEATH SENTENCE.

People are asking Jeb Bush to do something outside his powers. Why blame him, when the Federal Judges failed? When he supported legislation and then the Florida Supreme court wrongly said it went against the Florida state constitution? When the Florida legislature had a chance and failed?
Of all the powers, Jeb Bush is the ONE Governmental official who has been 100% supportive ... faced with enemies of the Schindlers and the case of Terri's life, in other branches of Government.

Could he do more, beyond his true powers as Gov?
We might as well ask YOU why you don't order a Ninja strike force to rescue her from death, or some other illegal fantasy act to get around the ring of cops Judge Greer has set up to imprison Terri in her deathwatch.

"All of the legislation, legal arguments, subpoenas, and posturing do not mean anything if she is allowed to die by inaction on the part of those who have the power to intervene."

The point is, 'those who have power to intervene' wear black robes. They want Terri dead. Dont take it out on Jeb Bush. Start impeaching Judges like Judge Whittemore and Judge Greer for their malfeasance, and then maybe next time we will see a different result.

I have posted this about 100 times already - a totally adequate legal premise exists for the governor to order the National Guard to go in. See this post for details. If you want the exact statutory citations, ask me for them.

I'm not surprised you don't have a clue what Section Two of the Florida Constitution says, and have no inclination to do a simple Google search to find out.

I wonder if the scumball husband has friends with the local cops. As we all know a cop is very unlikely to question another cop

The fact remains that they were even detained in the first place. They commited no crime, Greer is the criminal.
