Schindlers' Options Dwindle to Hearing Tonight with Federal Judge (Motion DENIED)
AP ^ | March 24, 2005

Posted on 03/24/2005 4:45:17 PM PST by West Coast Conservative

A federal court hearing has started in one of the last effort attempts by Terri Schiavo's parents to restore their daughter's feeding tube.

But the judge already has turned down the parents once. Bob and Mary Schindler are asking for an emergency order to reinsert the feeding tube in the brain-damaged woman.

The hearing in Tampa is before U.S. District Judge James Whittemore. He turned the Schindlers down once, as did a federal appeals court and the Supreme Court. A state judge, a state appeals court and the Florida Supreme Court also have all come down on the side of the husband, who wants to let his wife die after 15 years in what some doctors call a vegetative state.

The latest defeat for the Schindlers was today when a state judge said he won't go along with Governor Jeb Bush's request to order the feeding tube reinserted. The governor had said that new allegations of abuse of Terri Schiavo need to be investigated. The governor also tried to challenged the diagnosis that Terri Schiavo is in a persistent vegetative state.

I think they did it for political advantage, and for all the reasons you outline it didn't work. Just because a move doesn't gain political advantage doesn't mean that wasn't the goal. The whole coming back from vacation to vote on a pointless resolution on an issue that was popular with much of the base was 100% politics. Unfortunately for them between the transparency, the ineffectiveness, and the clear abuse of power it did them no good, and accomplished no good for the situation.

"sins" was used as an image. Whatever JB does will be thrown back to GWB and you know it even if it is unfair.

Ok, gotcha on that - But still I don't think anyone in their right minds (nor anyone in middle America who is only paying half attention to this) is going to lay any blame on either GWB or Jeb - It simply is not going to happen (no matter how the MSM try and spin it).

These are both good men - All this is going to do in the long run is make the values vote come out even more in 2006 -

How could they have a coup when at least three of us were out of the room?

Okay.

They really do need to schedule these little takeovers so that we can all participate!!

I would have brought the marshmallows!

I will say that I haven't been very impressed with the Schindlers' lawyer"""

The Schindlers are not sophisticated people. So they've allowed themselves to get hooked up with Randall Terry - when that was a sure way to turn off the media and forestall efforts to court reporters and editors. They should have linked up with a more politicially correct crowd - the disability-rights movement.

As for lawyers, I can't believe they wouldn't have been able to get some very high-powered conservative federal-court lawyers, by working with the Federalist Society.

Act first to save her life, worry about "legality" later.

That's kind of how I'm leaning too. Deal with it AFTER she gets some fluids in her....

So vince Dude, after that post and your give me liberty or death...just how is it you plan to die in pursuit of your stand against tyranny.

Me thinks you are full of hot air my dear. Like alot of people on this thread seeing this as the end of the republic, willing to turn on a decent man who is president and in general promoting a kind of separatism of themselves from the larger country we live in.

So the Bushes are "cowards" because they don't just cast aside obviously unjust laws they don't agree with?

Yes. You should know better than anyone that an unjust law does not bind and has no validity. And don't pretend otherwise.

Folks, I think this is getting a little out of hand now. I am as upset as anyone here about what is happening, and I am trying my hardest to prevent this tragedy from coming to pass.

That being said, I am still mindful of all that we have in this country and what we should all be thankful for. This is a very bad thing that is going on, but the fight is not over. Some of you appear to be willing to forsake the entire country and the leaders who are putting their careers on the line over this because of the potential for a negative outcome. This sort of schism, infighting, and defeatism is EXACTLY what the left wanted to happen during this. They want this to demoralize you, get you to sit out elections, and make clear the path for a liberal resurgence. They want you to give up on the flag, the pledge, your religion, and everything else.

I suggest that all of you stand strong with this. You can be damned sure that I will raise the flag back from half-mast when the time is appropriate, and I will be an energized as ever to right this wrong. We have much wrong here, but we still have much to be thankful for. I think in our heart of hearts, all of us knows this. Standing up against apparently insurmountable odds is what makes America great.

I've been hesitant to say it, but since you already have, I agree.

Those who know me well, know that I don't necessarily mince my words, and I do it within reason. LOL

Spot on.

The Roe decision was the first thing that flashed through my mind!

Oh, maybe for the purposes of making law so babies could get killed, the mother and any present/past/future killed baby was part of the count.

With attitudes like yours we would still be swearing allegiance to the British monarch. Cowards like you make me sick. We are dealing with tyranny here.

Here's Vince, throwing up over something one of the class posters of this website--PhiKapMom--says.

More from Vince:

There's no polite way to put it. Following your advice will hasten the ruin of the nation. It's time to stop bringing knives to gunfights.

PhiKapMom is, inadvertently, advocating the ruin of the nation!!!!

Yo, Vince!! Are you typing from Pinellas County? Or are you in your basement?

I've seen that assertion [Greer is a county probate judge] here at FR and doubt it strongly.

Yeah. He actually does probate for two counties.

The Sixth Judicial Circuit Information <-- Link

An Overview of the Sixth Judicial Circuit

As Florida's third largest trial court, the Sixth Judicial Circuit is recognized as one of the most efficient trial courts in the nation. The circuit is also recognized nationally for its automation leadership in support of court operations.

Fifty-five judges hear cases in the Sixth Judicial Circuit. Thirty-nine circuit judges and sixteen county judges are assigned to this circuit. The Sixth Judicial Circuit is comprised of Pasco and Pinellas Counties and is located on the Central West Coast of Florida.

Of the two counties, Pasco is geographically larger but smaller in population. In 1998 Pasco County had a resident population of 315,785. There are nine circuit judges, three county court judges, in two judicial facilities in this county.

Pinellas County's population far exceeds Pasco's population with a resident population of 893,468 in 1998. Pinellas County Courts consist of thirty circuit court judges, thirteen county court judges, and five court facilities.

...

Divisions Under the Circuit Court:

The Circuit Civil Division is a court of general jurisdiction for all civil matters that arise out of an issue amounting to $15,000 or more. In calendar year 1998 a total of 10,428 cases were filed in the Sixth Circuit.

...

The Probate and Guardianship Division handles all cases related to estates, trusts, guardianships, and mental health. These include cases in the mental health area such as Involuntary Commitment, Development Disabilities, Drug or Alcohol Abuse and Elder Abuse, Neglect or Exploitation. In calendar year 1998, 10,198 cases were filed in the circuit.

Anyone who thinks the GOP did this for a political advantage is off their rocker. Not only did they alienate most people who think this is a family matter, they alienated plenty of conservatives who think the same thing, and another group of conservatives who won't be satisfied until GW himself sends in federal troops to rescue Terri.

Well said. And I won't look at those posts you made last night after a little wine :-)

I certainly don't wish to offend anyone and am not really laughing. I find it rather sad that the hyperbole has reached this level. Also, after days of being called a Nazi, etc., I need to read a few posts like those being mentioned in order to realize that it is not I who is insane. But you have made a good point and I will have to think about how I react in the future.
