"As the instigator of the removal, DCF could initiate the pleadings in whatever court it determined should hear the arguments, it would seem to me."
Then you'd be incorrect. They'd be right back in Greer's court. The DCF doesn't get to choose the court, and this case is already active in a court.
The DCF wouldn't have a leg to stand on, I'm afraid, and that's the problem.

We can modify it...
First they came for the unborn babies
and I did not speak out because I was already born
Then they came for the handicapped
and I did not speak out because I was not handicapped...
This doesn't stop with one handicapped woman!!!

Greer is reportedly a conservative Republican, Conservative Republicans can be paranoid egomaniacs too...

"A delay can also mean Greer is actually considering the motion and looking for legal support..."
Doubt it. I just think the Judge is showing judicial courtesy to the Governor, in pretending to review the petition seriously. It would be an extreme insult if his verdict was returned in minutes.
Remember, he knows that bridges will need mending after this is through...Greer is covering his butt....IMHO

If you so strongly believe that every hour counts, then you should be able to find a dozen armed Freepers and rescue her. Are you so chicken that you'd prefer to blame Jeb Bush?Brilliant. Just think how intelligent you would be if you had breathed some oxygen at birth.

>>I just got off the phone with the governors office in Florida giving them my two cents worth. She told me that the judge (Greer) has already denied the request. I asked her to clarify which request, and she said the one that was being decided today over DCF. For what its worth. Anyone able to back this up<<<
Well there you have it.
Jeb will come out later and say "We did all we could".
I still have no idea WHY Jeb would hold a press conference yesterday with the DCF stating the did not need permission to take Terri.
To: Future Useless Eater
I agree he should go for it. Should have done that in 2003. Or as late as last week. But I'm trying to understand his thinking. If he's so meticulous about staying within the law, maybe there's some fine point of law, like Felos was talking about, whereby if a ruling goes against you and you appeal, you get some kind of automatic stay that lets you act. If so, then what Felos described---the DCF having a 3-hr opportunity to take Terri---might be open again if Jeb appeals a ruling by Greer. It's not what I think a governor should do, I think he should be a leader and just go get her.

I believe he's trying to find an avenue that assures she can be rescued with being taken back in 3-4 days.**************
I agree.

Amazing! You just called on three ultra-liberal organizations to save Terri. I'm sorry...I guess I thought this was a conservative forum.

I don't understand how he can have jurisdiction over state law enforcement agencies.... he's a COUNTY judge!Crud! Are you kidding me? He's a county judge?
To: Non-Sequitur
Actually, DCF does not have to remove a guardian in order to take protective custody of Terri. DCF would have to petition a court at some point, but not in order to take protective action.
To: Chad Fairbanks
Something within his constitutional power. Why do you ask?Because I see you screaming (I've seen it before) for the President to do something without offering any suggestions as to what that something might be
Pretty constructive - but only if your goal is to raise your own blood pressure.

People who use this tragedy as an excuse to bash a President who has taken unprecedented measures to stand for a culture of life disgust me. Amen - wonder if some are DU trolls intent on pushing the illusion that if Terri dies - it's all jeb and "W's" fault - this is exactly how the lib/socialist's operate. It sickens me to see how many on our side swallow this cr*p

Amazingly this so-called "Conservative Republican" Judge ruled in favor of a husband in a spouse abuse case and the husband ended up stabbing the wife to death. Apparently this judge seems to have a habit of ruling on the wrong side and seeing people die because of it.
