If I am to be totally honest here, I'd have to say Terri is dying from bad lawyering more than bad judging at this point. No. Terri is dying from bad judging. Don't throw the blame at the lawyers. Good lawyers cannot convince bad judges of anything. Bad Judges will make bad decisions no matter what any lawyer says or does.

In October 2001, the Schindlers had filed an affidavit by a Dr. Webber supporting their case, and mostly based on such affidavit, the appellate court ordered a second trial.
Nevertheless, Dr. Webber changed his mind before the second trial in October 2002, and the Schindlers were left with only one neurologist/neurosurgeon: the controversial Hammesfahr, who was all but called a quack in court.
From the opinion by Second Court of Appeals filed on June 2003 [page 4, last paragraph]:
On remand, this court anticipated but did not require that Dr. Webber, who had claimed in his affidavit that he might be able to restore Mrs. Schiavo's speech and some of her cognitive functioning, would testify for the parents and provide scientific support for his claim. However, Dr. Webber, who was so critical in this court's decision to remand the case, made no further appearance in these proceedings. Instead, the parents provided testimony from Dr. William Maxfield, a board-certified physician in radiology and nuclear medicine, and Dr. William Hammesfahr, a board-certified neurologist.

Yes, bad judging started this down that path but...
Gibbs has had several opportunities in the past week to make some of this right. He has, for all intents and purposes, blown it. He is just now trying what he should have done on Tuesday of this week, putting together a coherent strategy on proving the rulings were fatally flawed from the start.
It in no way absolves Greer, who is the true bad actor in this mess.

I live in Washington State, and my Geo Metro would make it and not use much gas but I would be there in time (maybe) to attend the funeral, if her can parents arrange one. as i understand it, michael has long ago petitioned and got from greer permission to cremate immediately and even got the okay to PAY for it from Terri's rehab money - the rehab money awarded for her rehab which he forbid her to have....connect the dots

I suggested before, but after additional research, I believe an executive order has to be related to a specific point of law. It might have worked had the original verision of the bill which granted an immediate TRO been passed. which, I have little doubt, is why the dems stonewalled the original version and made it clear they would not let it pass - they knew the second one that they wrangled would produce this result - deceitful b*stards.

WOW! I couldn't agree more -- that's despicable. Having Randall Terry for their spokesman doesn't sit well with me either.
After hearing Judge Bork on Hannity, I am beginning to wonder about the legal team representing the family -- where they came from, who is behind them, etc.
This is beginning to smell in more ways than one.

It just does not compute. I can't not believe that one judge with his shady past can hold judgement over the Senate, Congress, President, and the Govenor. We might as well save all of the tax payers alot of money by sending every politician home. We have no need for them anymore. A judge can decide our fate now. We have been seeing this rule by courts for some time now.
How many times, for example, have the people of different states passed votes to ban gay marriage only to have a judge throw their vote out?
This means we are being ruled now by the long black robes. Anytime We the People vote in or out against their wishes, it will be overturned.
Why do you think the dems are so adamant not to let Bush appoint conservative judges?

Therein lies the rub. The Shindlers have been ill-served in their legal representations. If I am to be totally honest here, I'd have to say Terri is dying from bad lawyering more than bad judging at this point.I am totally convinced you are correct. I want to know who is behind these lawyers and who got Randall Terry in there. This should have been faught under the Americans with Disabilities Act it looks like to have any success. At least lawyers versed in that would have stood a better chance then these incompetents.

Michaeal Savage this past week on his radio show has let it all hang out. He has so far given both Bush's some slack, but if they let Terri die he may vent. once and for all - the Bush's are "letting Terri die" - michael and the black robes are ordering her to die.
Let's keep the blame where it belongs...

Frankly, if this goes on after noon tomorrow, I will begin to think it more humane to let her go than bring her body through the trauma of recovery. I believe this is basically why Jeb hasn't just grabbed her first - to do so would only give him a 3 day window before the courts would rule her back off the tube - prolonging the barbarity of it all for her - he;'s trying to find a way to get her guardianship changed permantly
