Just a thought........would Thomas and Scalia vote not to take this case to expedite Jeb's ability to intervene before Terri dies........i.e. TODAY??
I am wondering if Gov. Bush is just waitinng for Greer to rule this last time and then make his move.

I was curious about the "unanimous" decision. Normally doesn't the Justice (in this case Kennedy) make a decision as to whether to take it? Then it can go to three Justices? And only later to the full Court? I know I'm very fuzzy here, but does anyone know the procedural details?
