"U.S. District Judge James Whittemore (search) of Tampa would preside over the hearing, attorneys said. Whittemore on Tuesday denied the Schindlers' request to have the tube reinserted, saying they had not established a "substantial likelihood of success" at trial on the merits of their arguments. "

Just my take---this country is outraged that this is happening to Terri especially in light of the allegations of abuse by Michael. Maybe this judge is seeing this as a "stepping stone" to something else for himself down the line, and now could be the hero who at least grants a de novo hearing of the new evidence...I am just thinking this because this judge seems to want to hear the case now.

You might be on to something. Why would he want to have the case in his court again if he's just planning to rule the same way? Particularly if the rumor is true that he initiated the latest appeal.

Judge James Whittemore will dismiss the motion. He is too friendly with Judge Greer to go against his ruling.

"this country is outraged that this is happening to Terri especially in light of the allegations of abuse by Michael. "

According ABC's latest poll, 82% of Americans want Terri to die now. However, most Americans don't know about Michael's common-law wife and his two bastard children nor that Terri has never had an MRI or PET scan nor that Terri originally arrived at the hospital with a possible broken neck and other broken bones inconsistent with Micheal's claims that Terri had suddenly collapsed.

They are right that judges don't invite litigation, but
he said he would hear it and to have everything submitted by this afternoon/evening.
