The Schindlers' attorneys said they planned to request a temporary restraining order so new evidence could be introduced in federal court. A hearing was set for 6 p.m. EST.
U.S. District Judge James Whittemore (search) of Tampa would preside over the hearing, attorneys said. Whittemore on Tuesday denied the Schindlers' request to have the tube reinserted, saying they had not established a "substantial likelihood of success" at trial on the merits of their arguments.

Just my take---this country is outraged that this is happening to Terri especially in light of the allegations of abuse by Michael. Maybe this judge is seeing this as a "stepping stone" to something else for himself down the line, and now could be the hero who at least grants a de novo hearing of the new evidence...I am just thinking this because this judge seems to want to hear the case now.
Bobby Schindler, who last saw his sister around midnight Wednesday, told FOX News that the best way he can describe Terri's appearance now is by comparing it to that of concentration camp prisoners in Germany during World War II.
"It's extremely sad and I can't believe I'm watching my sister die this way," he said. "It's the most inhumane, cruel thing I'm at a loss for words. I don't even know how to describe what I'm feeling right now."
When I close my eyes at night, all I can see is Terri's face in front of me, dying, starving to death," Mary Schindler said Wednesday outside her daughter's Pinellas Park hospice. "Please, someone out there, stop this cruelty. Stop the insanity. Please let my daughter live."
