TAMPA, Fla. (AP) A lawyer for Terri Schiavo's parents says an appeal to try to keep the brain-damaged woman alive has been filed with the U.S. Supreme Court.

Thanks for note. It has been an interesting experience for me. I sometimes wish Unitarian churches were not so Commie. If they were not, I would be tempted to attend them just to annoy a certain poster. And so it goes.

I am not "blaming" Jeb Bush -- that's why I added the last statement, that I know he is doing everything possible.

But I just don't understand that you can pardon a guilty person, but a judge can condemn an innocent one to death and you can't.

Honestly, I do not know. I think 24 hours is the emergency provision.
It looks from reading it even with the emergency provision there has to be a hearing within 24 hours.

I imagine the hearing will go against DCF anyway.

Greer would not let any testimony in unless it was in MS favor, from family members, friends, nurses, neurologist. Was he breaking laws - is that what he should do?

I'm not a lawyer, but I would imagine that is up to a judge's discretion. If someone isn't satisfied, I believe they have the option to appeal. I haven't followed the legal history of this case, so I have only a sketchy idea of what has been done in that regard.

MS has no right being her guardian - a true conflict of interest - yet he is guardian. A unbiased judge would not have continue along this path.

I don't know if his guardianship has been credibly challenged, or if it can be under Florida law - but I agree that it should be, and if the law doesn't allow for that, that is something that should be changed.

That doesn't make sense to me, either, but that's apparently the way it is.

This case has really highlighted how the law can fail a helpless, innocent person.

I'm wondering if either of you know why the Schindlers have not had their causes of action tried as of yet. Why didn't they push for trial when injunctive relief was denied? Were the original pleadings geared only toward injunctive relief without including a plea for declaratory judgment and damages?

I am just so mad and sick about all of this. Am now listening to that horrible Estrich woman yet again.

I cannot believe our country has come to this. Coulter was right today......our Republicans won't "move" in and do what they should do to save Terri.

I could post a lame comment about "what a shame" it all is. But I can't do it.

A woman's life is on the line now. She will die.

The trial will proceed in regular order until such time as Terri has an unfortunate death, and the matter is rendered moot.

Sorry can't link. But there is a very good article by World Net Daily,and they quote theDFC lady from this afternoon, and she says she is not bound by any previous court proceedings.
A very good read.1st official I've heard that is standing up to that creepy judge.

I did read that.

I am confused on the law . I think Jeb Bush does not want to take Terri now and have her tube reinserted just to have the petition for a protective order denied 24 hours late. The tube would have to be taken out and the starvation process would start all over again.

The injunctive relief asked for was to reattach the tube (and remove her from hospice). If that ruling isn't turned around - so water/food can start again -- trial would be futile, because it (with appeals) would last longer than Terri would.

Absolutely. HE gives us His strength - to do His will. We need to step out in faith - with His strength. We do have power against evil - He gives us this power. If not - evil will rule us. We are His ambassadors here on earth. Either we have faith in Him while we carry out His will or we sit back and get into the deeper mess and are useless.

Jeb is in the position to do something. With power, comes opportunity. Much given, much expected. Perhaps Jeb was raised up for such a time as this.

Totally agree...As to what Jeb must do, that is between him, his conscience and God. I have not said anything about the republicans or never said I didn't respect Jeb.

Sorry you had to waste your time arguing with those who want to destroy life. What do they care about..Thou shalt not kill. No need to throw pearls before swine. If someone doesn't know taking a life is wrong - no amount of pursuasion will change them. That's a deep problem they have from within.

But with the holiday coming the delays are a bit longer if you look at the statute.
Someone else said that she would be moved to another county facility and the petition would be filed in a different court.
That lady did not sound intimidated in the least though.

Yes but the tube could have been ordered attached after trial on the merits. Right now, Terry is being denied a feeding tube based only on a perceived lack of probable success on the merits, but not upon an adjudication upon trial of the merits themselves.

It's a bit like claiming, in 1995, that the Packers would not appear in two Superbowls in '96 and '97.

It bugs the heck out of me that Greer's preliminary rulings are causing her death.
