Jeb Bush Renews Call to Help schiavo

PINELLAS PARK, Fla. (AP) - Their options dwindling after two failed federal court appeals, Terri Schiavo's parents and brother vowed Wednesday to take their fight to the U.S. Supreme Court and state Legislature as the brain-damaged woman was in her fifth day without a feeding tube.

Gov. Jeb Bush renewed his call for the Legislature to step in and ``spare Terri's life.''

In a 2-1 ruling early Wednesday, a panel of the 11th Circuit Court of Appeals in Atlanta said the parents, who have battled with son-in-law Michael Schiavo for years over the woman's fate, ``failed to demonstrate a substantial case on the merits of any of their claims'' that the feeding tube should be reinserted immediately.

``There is no denying the absolute tragedy that has befallen Mrs. Schiavo,'' the ruling by Judges Ed Carnes and Frank M. Hull said. ``We all have our own family, our own loved ones, and our own children. However, we are called upon to make a collective, objective decision concerning a question of law.''

I have heard that the parents are being forced to stay far enough away from her in the room to prevent any attempt to offer her anything. But I have heard so many things lately that I do not know if that is accurate. I really don't even know if they are allowed in the room at all.

Here is the email message I sent the governor earlier:

Governor Bush,

For the love of God, take Terri into protective custody. Base it on the effectual obstruction of justice that Greer has in essence committed in denying protective care to Terri while the state protective service abuse investigation regarding her is ongoing and until that investigation is complete.

The very object of that investigation is to PROTECT TERRI. This cannot happen if she dies. Greer has trampled separation in his comments regarding the request. Either get another Judge to issue the order and use that to take her into protective custody, or act on your executive authority and constitutional standinge as Governor.

I am talking about call for anarchy and the President to break the law. Go back and read some of these comments -- they are over the top.

I have as many emotions as anyone over this but I also know that the President or Governor has to work within the law even if it is a bad law. They cannot pick and choose which laws to abide by -- our Country has never worked that way. I detested Executive Orders of Clinton and my stance has not changed today.

Both men are doing everything they can under the law and I believe they will find a way to save Terri but in so doing they will have preserved our laws and Constitution for the future.

If you want to do something -- ask the Florida Senate to pass the bill -- that is an action we can influence and with that Jeb can them move in and protect Terri.

The Schindlers are not wealthy people. They have had to depend often on pro bono lawyers. But they ran upon in Pinellas County is some of the worst judicial corruption in the history of the USA. No lawyer could have convinced George W. Greer or the clintoid in FL, Whittemore, of the nature of the fix against Terri.

I am praying for the Florida Senate to act when they convene about now -- that is a better hope then the Courts. If the Florida Senate passes the bill, then Jeb can act!

How did you get the idea that I'm on the side of Michael Schiavo?

Perhaps I should have isolated the part of the post to which I replied, "Spare me your sixth grade Michael Moore logic." It was to the poster's straw man about the moral relevance between this and the Iraq war.

By the way, if there is a definitive request from Ms. Schiavo that says this is what she wanted (which there isn't, and you know it, and so does everyone else), why hasn't it come out yet?

And I'll pose the question that Rush just asked, in response to yet another person that said that this is all just "pandering to the religious right": Do those of you who want Terri Schiavo to die, want it because some Christian conservative wants her to live?

My sister, who was a neurologist who advised her terminal patients not to use extreme measures to prolong their lives, also changed her mind about it quickly enough when she got ALS. I think, in the end, most of us will want to live vs. the alternative (extreme pain cases may be different).

It's effecting the entire Nation, and most of the World.

Martha Stewart went to Jail for prejury.., but here will have numberous, numberous,etc.....evidences...., and they protect him, why ? Everything is up-side-down, you got the Fathers (Pro-Family) Movement defending Women Rights for VICTIM of DOMESTIC VIOLENCE, and where's N.O.W. ???

Have they Left EARTH ? We can't find them :0

I accept your clarification and I think, it's almost the same frustration I have! I am heartened to see some politicians actually speak up and try to get some real attention to the matter. I am sickened, however, by those (and I initially thought you were one) who completely down play any human side to the situation. I can respect and understand the role of law. I do not believe however, that each law is above reproach because it simply 'is' and must be honored. I believe there are many laws in our nation's history that turned out to be pathetic and dispicable...but only after people did speak up in outrage and people did take action in outrage......

I can't just accept a case that follows the law because the procedures are deemed 'correct',,,,following the law to the letter is less important than doing something compassionate and merciful,,,and that's just my humble opinion. I fear for the fact that now as a public we are to accept that food and water are termed 'life support' and 'medical intervention.' I don't care if Teri can get better or not,,,her quality of life is not mine to judge. I see her as alive, as alive as anything. I don't care if she can communicate or swallow or interact or have a coherent thought. She is alive and that alone is enough reason for me to say she should be kept in that state as long as possible and until the good Lord takes her away....

I want to warn people who take Terri's case as a rush to have a living (death wish) will.

The situation may come down to a dispute between an institute (nursing home, hospital, Hillary's retirement facility) and your family members. Since they have your will stating that feeding tube is not allowed and you can't communicate for whatever reason, the institute can stop feeding you legally against your family members' wishes. When you bring the case to court, good luck! Starve first, while we talk. And, we're going to take our time to talk about it. Remember, starvation is a peaceful way to die after all.

Would you approve of the President taking extraordinary measures to secure Terri's safety in defiance of the courts, i.e., ordering Federal Marshalls to take her into protective custody - things that may not be considered currently within Presidential powers? Or, maybe purposely defying federal and state judges rulings doing other preemptive actions to help?

Thanks for that reasoned response. Probono just doesn't do it sometimes. Next question -- why didn't the pro-life groups get them a lawyer? Plenty of money is donated to them.

Just don't see how it was allowed to get so far that she could not be given food/water by mouth -- that should make every American mad no matter what their ideology. That is cruel!
