Convicted felons get appeals. Sometimes, gasp, they lose the appeal. Go to death row. And then, years later, lo and behold! They are found not guilty of the crime! HOORAY!

Unfortunately, Terri won't be around if it is found she was "not guilty". God, this is so sad.

Can you cite a legal rule or precedent requiring him to see her?

I want to know why the Schindler's attorneys did not supena her to testify. They could have called her as a witness, just like Congress has and did.

No, but I let him know this is urgent. He said that he knows and said emphatically that this is a 3 Judge panel. I think he was trying to tell me "hey...this isn't only one judge".

That sounds like a convenient way of accepting that Terri be starved to death.

Look, God's will may be different than mine, I have no clue. Neither do you. That is why I'm fighting for her LIFE. I will expend all means to defend that life rather than take a passive role and assume God's will is being done.

If that be the logic I could easily posit the hypothetical that I saw a car about to hit a bystander, could have screamed to give them warning, but chose to content myself in the thinking that the car would miss the person if God willed it.

We have a certain responsibility to defend life. What happens outside of that IS beyond our control but she will not die because I passively stood by.

I have no doubt God will use terri to make a difference, perhaps he already is in opening our eyes to our current culture.

Again, looking at the opinions, I find no fault with his interpretation of the facts.

I think this is the part that so many people take issue with and that is that no one else has had an opportunity to review what "facts" were not admitted. You can review his rulings and agree with what he entered into the proceedings as "facts" and then say you agree with his interpretation of those facts. But what about what he refused to accept as facts? An appelate court is not going to get into that, are they? I thought they reviewed his opinions to see if he erred as it applied to laws, not his judgement in admitted certain "facts".

Your points are well taken..however, we don't know in what context these statements were offered. Were they solicited...were they in response to a question as you state. Having been in a courtroom many times (no, I'm not a lawyer..retired law enforcement) people always paraphrase what the conversation was in their simplest terms. Since there is also evidence that she made statements to the contrary, and since the Schiavo witnesses have an interest in the outcome of the case, you decide. The point that I don't underatand that is not getting the attention of the media is the conflict of interest of Greer acting as Teri's guardian and as trier of fact.

NO. This FReeper will never ever "come to grips" with the forced starvation of a brain-damaged woman whose wishes are not known, yet alleged by her slime ball husband to be that she wanted to be starved and dehydrated to death rather than take advantage of 21st century therapy and rehabilitation. When our country allows an estranged husband to have the courts order to starve a wife, something is very very wrong and no, I personally will never accept this. Judges are not supreme beings. They are lawyers who wanted more power. The judiciary does not make the laws, the legislature does. The federal judge did not do his job. He was supposed to conduct a de novo (NEW) hearing, not affirm Greer's incompetence and malfeasance in the matter of this helpless woman who has been deprived of her life and liberty with the blessings of the court. The judicial branch needs to have the smack down on them.

I doubt it. I imagine she spoke to some kind of court clerk, who would not be able to give any answer to such a question.

The judges are in session, considering the case. Once they're done, they have to reach a decision and put it in the proper form. If an injunction or restraining order are to be issued, that will not take them long. If not, then you can expect to hear nothing until tomorrow, after the complete decision has been written up, a document that will encompass many pages and have to be letter perfect.

So, if there is no injunction or restraining order issued by late this afternoon, you can figure none will be forthcoming and the decision of the court will be released tomorrow sometime.

In this case, no news will be bad news for Terri.

You won't be vilified but I just wanted to point out to you that you are right that we a nation of laws.

Supposed to be.

There are specific laws and statutes that HINO was supposed to follow and didn't and when it was brought to the attention of the court, Greer said oh well.

There are laws prohibiting a judge from declaring himself Terri's guardian ad litem, ignored.

I could go on and on....

Florida tried by initiating a new law. The courts told them that that law interfered with a court ruling, and was therefore invalid because of 'checks and balances'.

Where is the check on the judiciary? It used to be the Executive and the Legislative branches, but the judiciary ruled that that wasn't permissable.

How can anyone claim someone is terminally ill when they are not brain dead, just brain damaged?

Because people(doctors) will sign just about anything when they see $14,000,000 they can have a share in.

The NEW doctor Michael had hired (after Gambone quit due to "being ruled not credible", being asked to state TERRI was PVS and SIGN to that effect, which he refused to do.) is being sued for MALPRACTICE. Those are the best doctors to get as they will SIGN ANYTHING FOR MONEY.

The court made him guardian, despite obvious conflict of interest. He can easily be removed as guardian by another court. He should have nothing to do with her at all,given his continuous abuse of her.
Like denying her access to outdoors, or having her teeth brushed.Please reconcile that with Schiavo creepy statement that :"she will always be in my heart.
Most people who have to deal with dying relatives or very sick relatives have as their primary concern to make that person as comfortable as possible.
The monster is doing exactly the opposite.
Her wheelchair broke in 99 and he refused to replace it.

They did not, because she cannot testify. If she could, her presence in the court and ability to testify would have ended the case immediately.

Sadly, she was not able to testify at that time, and is, apparently, not able to testify at this time. That's why she's a ward of the court.

After reading Judge Whitmore's decision, I truly believe the person who failed here is the Schindler's attorney. Why didn't he introduce new evidence at the hearing. Whitmore even comments on that fact. For example, everyone has complained that Judge Greer never met with Terri. Couldn't Gibbs have called her as a witness? It may have failed, but it would have at least raised the issue a bit more.
