Just on Fox: Judge going back to chambers to review plaintiff (parents) request for restraining order and tube reinserted.

TAMPA, Fla. — A federal hearing ended without an immediate ruling Monday afternoon on whether to impose an emergency injunction to reinsert the feeding tube of Terri Schiavo (search), a severely brain-damaged Florida woman.
U.S. District Judge James Whittemore (search), who was nominated to the court in 1999 by former President Clinton, listened to arguments during the hearing he scheduled in Tampa that began about 3 p.m. EST Monday and ended about 5 p.m.
Whittemore was considering an appeal filed Monday by Schiavo's parents. The judge said he would not make an immediate ruling, and he gave no indication on when he might act on the request.

I've come to the conclusion that Michael Shiavo certainly is not acting in her interests at all, but out to destroy her. (I've seen and read how he has refused therapy for her time and time again, moved her from home to home, and has just been brutal about her outcome.) This is certainly not a man that is committed to taking care of her at all.
Why then do I as a layman see the absolute travesty of justice taking place here, yet the judges need time to think this through?!
I am sorry, but Michael should be in jail at this moment, Terri should be in custody of her parents, and the marriage between Terri and Michael should be rendered null and void.
If I can see this 2000 miles away, why can't the judges?
I know most of you feel as strong as I do, and see the same thing.

Wow, no kidding! Anytime Judge Napalitano says anything that isn't what some want to hear, even when he is merely stating how the judicial system works, some folks have jumped all over him. He isn't voicing his own personal beliefs, he's just explaining the system, and what he thinks may happen based on his knowledge of the system.
The courts in our beloved Country are now TOTALLY OUT OF CONTROL. We have judges making law and totally disregarding everyone of our constitutional rights provided to us by blood, sweat, and tears. Our men and women have died for us so that we could have freedom. Now, we have judges that thrive on death brought on by greed and self promotion. Judges have given their ruleings and now, no one can dispute those ruleings.
SOMEONE PLEASE SPEAK AND LEAD US OUT OF THIS JUDICAL QUAGMIRE. It is time for everyone to recognize that we are no longer a free society while judges have the power to exert their will on us. WE are now in a judicial dictatorship

Having watched Napolitano for several years now, as a lawyer, I consider him a legal hack. Competent and experienced in things like the Peterson or Jackson trial, and in trial strategy and the like. Out of his league in anything complicated, like Bush v. Gore or Microsoft antitrust or arguments by people like Mark Levin and judge Scalia on judicial activism. People give him too much credit. Don't hate him, but don't take what he says as more meritorious than it is.
Late last night I watched Larry King interview the husband. His demeanor was so much like Scott Peterson's it was scary. Throughout the interview, Larry seemed to empathize with him, but I laughed when one of Larry's final questions was, "Would you take a lie detector test?" Michael Schiavo said, "No."
Larry asked him why the parents are doing this. He had the nerve to say they want money, and they want to "ruin my life."
Later, the parents were interviewed and were gracious enough to say they didn't know why he wanted her to die. As everyone knows, they've suggested he divorce Terri and make them her guardians. That would be the answer to all of this. After all, he has a girlfriend and two children with her, so he's moved on.
My heart goes out to these parents....prayers, too.

I thought the judge was James Whitmire (sp?)--Fox had a picture of him on the air.

I posted last night about a child I know who was born with his umbilical cord wrapped around his neck, cutting off oxygen and causing brain damage. He appears and sounds remarkably like the photos and videos of Terri that I have seen.
I asked the person I posted to if it would be all right for his parents to just quit feeding him, as he is inconvenient and a burden to them (they don't feel that way at all, however!). The person to whom I posted did not answer, nor did anyone else. Wonder why!?!
The sort of pragmatic, Godlike power that some future "ism" may use to expunge society of religious "malcontents" and opposition. Declare them insane, allow a period of time for rehabilitation and if the desired result is not gained, elimination.
This would have quite the chilling effect on the rest of society, but then again, we must exercise our basic right to die. /sarcasm

LOL. That is so funny after last nights marathon session to pass a law for one person to overturn everything that has happened to date in state court. Talk about due process!
That's interesting. The man who is the spokesman for the famil said it was a female Judge. Jane Whitmore or something like that. Does anyone know for sure???????????
When a president gets out of bed to sign this into law, and the judge turns up his nose and takes a three-martini lunch before hearing it...he's gotta be making a "little gesture" of contempt to all the branches of government.
Maybe we should do more than just write posts. Maybe God is telling us we must do more. Maybe it is time for us to take matters in our own hands. What would they do if people throughout the US refused to go to work. How many are there of us? Are we enough to make a statement? Are we strong enough in our convictions to take a stand that could cost us personally? Are we willing to make a sacrifice?

But I thought this is a different country, apparently it isn't.
We are think, that we have a President and Congress, but actually we are being ruled by judges.
If you followed the case closely, you would clearly see that Greer has IGNORED about 15 Florida statutes. Any one of which would have Terri in rehab and being treated now - not being starved to death.
Just because there was a "process" in his court doesn't say it had DIDDLY to do with the LAW.
