Constitutionally, the Congress is the judge of judges' performance, in that it has the sole power to remove them.

If one is not going to impeach a judge for consistently misinterpreting the laws, then there is no power of impeachment, and we can declare judges to be our overlords.

But the power to deem 'misinterpretation' would then be placed with the Legislature? Isn't that just another form of interpreting the law...not their function. You would then have judges making decisions based on what the makeup of Congress is(their chances of surviving an impeachment). There are no easy solutions here unfortunately.
