But the power to deem 'misinterpretation' would then be placed with the Legislature? Isn't that just another form of interpreting the law...not their function. You would then have judges making decisions based on what the makeup of Congress is(their chances of surviving an impeachment). There are no easy solutions here unfortunately.

But if the people feel the power of impeachment is being abused, the next election is always less than 2 years away. If the people feel the power of the judiciary is being abused, what recourse is there? None whatsoever, except through their representatives, and the name of that recourse is impeachment.
