there are 3 entities that are legally able as of this minute to take terri into protective custody:
The US Gov't: she is a federally protected witness
DCF: going on the information they have already
The state of Florida: her caretakers and 'guardian' have violated state laws..

All Jeb Bush needs is a reasonable suspicion that she has been victimized in any way. Judges and police and DCF workers all have some immunity from prosecution if they act on their own discretion with proper motives. Same goes for the governor doing what a governor can do.

As long as he is acting in good faith in the interests of Terri's welfare, he is legally on very safe ground.
