Michael, remember that the US is a federal republic. The US Constitution was meant to regulate a small federal government, and the state constitutions were supposed to deal with these family matters.
Nevertheless, now that the big federal government has stuck its nose into the a state issue, a federal law will probably pass sooner or later.

That´s exactly the point: it was meant as a constitution for a union of sovereign states. IT WAS MEANT! It is no longer, since nobody seriously says Florida, Michigan or Oregon were sovereign states. The powers of the states and the federal stage need to be reformed.

The only purpose there is for a government is to protect it's citizens rights. Terris rights have not been protected and the State and Federal government have a responsibility to intervene here.
