Man Found Napping in Car With Holdup Note

QUINCY, Mass. -- It's never good to fall asleep on the job, but when you're a robber the consequences can be severe. Police arrived at a CVS pharmacy early Tuesday morning to find Steven Jakaitis, 42, sleeping in his idling car with a nylon stocking over his head and a cap pistol in his pocket.
By his side was a note that read: "I have a Gun DO NOT Press any Alarms or let Custermors (sic) know Empty the All the register."
A customer called police after seeing Jakaitis, who was also wearing a black wig and a scarf. On the back seat of his car, officers found a plastic bag containing 36 unused hypodermic needles. He spoke incoherently after the officers woke him, Capt. Anthony DiBona said.
He never actually went into the store, police said.
At his arraignment Tuesday, Jakaitis pleaded innocent to attempted armed robbery, possession of a hypodermic syringe and receiving a stolen car. He was ordered held on $1,000 bail and ordered to appear for a pretrial conference on April 12.

Conspiracy to commit an armed robbery would be a possibility, if such a statute exists in the state.
I would imagine he'll just plead down to some low level charges and get sentenced to rehab.

What is the crime? He was sleeping in his car, about to commit a crime, maybe? I think a first year law student should be able to get this guy off.
Unless, he was in the getaway car and we have only half of the story.

Sounds like he had a stolen car, so they can get him for that. But even conspiracy sounds fishy unless they can show he was planning it in cahoots with someone else.
....hey...you're suppost to take the quaaludes AFTER you rob the store....
He's hazing himself.
He was illegally in possession of a stolen car and a bunch of hypodermic syringes, add in the cap pistol, the disguise and the demand note all being discovered at or about the scheduled opening time of the store and the fact that most cash registers are electronically-controlled and likely empty at opening time and I think they could prosecute him on capital-stupidity charges.
That comma should be inside your quotes.
I missed the stolen car... the rest should not be crimes other than what you've pointed out, "of stupidity."
The point is he did not attempt -- he went so far and stopped. Stopped before an attempt. Slept on it. Sorry, there just ain't no crime here.

Possession of a stolen car -- that's a possible crime. Did he know it was stolen? Hypodermic needles are legal, afaik. Diabetics and cenacer patients, etc, make use of them daily.
