Without consulting Justices Kennedy, Souter, Breyer, Stevens, and Bader-Ginsburg first?That's exactly what I thought, too. These juveniles were not susceptible to deterrence because they were obviously unable to make the kind of cost-benefit analysis that would have attached any weight to the possiblility of execution, not to mention other mitigating factors such as the birthday cake, chimpanzeehood abuse, poverty, etc.
