Judge releases DCF document in Schiavo case

A judge released the DCF document seeking intervention in the Terri Schiavo case. She's the brain-damaged woman at the center of a "right to die" battle.

The department of children and families document names Michael Schiavo as responsible for the mistreatment of his wife. The nine complaints cited are very technical. They essentially claim the abuse or neglect of Terri is in the form of the kind of medical treatment Terri is, or in some cases is not receiving.

The complaint accuses Michael Schiavo of: 1. Failure to educate using certain therapies in violation of guardianship 2. Experimental procedures performed without proper medical and legal procedures observed. 3. Lack of manipulation of the ward's (Terri’s) arms causing severe contractures

Circuit judge George Greer says he will make the document available to the public tomorrow. Greer ordered Terri Schiavo's feeding tube be removed March 18th.

Don't get me wrong. I disagree with the name-calling, the made-up "facts", the distortions, the lines taken out of context, etc., that many on Free Republic are touting. I do think that this saga has degenerated to the point where it is more about the Schindlers and Michael Schiavo than it is about Terri.

I can't post the whole thing -- copywrite issues, apparently -- but here's an excerpt:<P
Schiavo was a healthy 27-year-old at the time she suffered cardiac arrest and lost consciousness. ...She made very few oral statements regarding her attitude toward artificial life support. None of her statements was made in a particularly serious context or elaborated upon with any detail. None of her statements addressed the specific issue of receiving food or water. Under facts such as these, a court would ordinarily conclude that the evidence is hopelessly in equipoise -- the classic ''six one way, half a dozen the other'' situation.

In such situations, the evidence cannot provide clear and convincing proof that the individual would want to discontinue treatment. As such, Florida law dictates that we err on the side of life.

Procedural rules that effectively deny reconsideration of this critical issue have forced Schiavo's parents to devise new arguments to keep their daughter alive. ...

The judicial process has failed Schiavo and forced the other two branches of Florida's government to act in extraordinary ways to remedy an extraordinary wrong. Ironically, the Florida Supreme Court has ruled that these attempts are unconstitutional violations of the separation of powers doctrine.

The Florida Legislature should try again.

There is simply no way that an average person could endure what the Schindlers have faced for so very long. They absolutely must have divine strength holding them up. And MRS hates them because they are standing up for principle and common sense.

I do think that this saga has degenerated to the point where it is more about the Schindlers and Michael Schiavo than it is about Terri.

It's about more than Terri and you know that. All the excuses and off topic discussions can't change that it's about euthanasia.

Ruoflaw You posed a very good question.

I don't really tend to believe that judge greer in engaged in a criminial conspiracy in the traditional sense of him having a financial interest taking kickbacks or bribes from mike shiavo or george greer.

Rather the judge is quite morally bankrupt.

THE MAN IS GUILTY AS CHARGED.

he definitely has an agenda . He is a want - a - be great judicial advocate that envisions himself to be equal to past and present judges in the supreme court.

In reality ole' george is just a garden variety probate judge who probably flunked bar examination at least once in the state of florida.

The man really believes in the hidious practice of euthanasia.

This case ruling would have been in his mind is the crowning moment in his worthless and pitiful life where he fervertly believes that his callous ruling againest an innocent women will be the definitive case that will pave the way for legalized euthanasia in florida.

THE MAN HAS A WALTER MITTY COMPLEX OR A OEDIPUS COMPLEX.

HE LIVES IN HIS MINDLESS DAY DREAMS .

The strange part of all of this is george greer is in a judicial post that is elected rather than a post that is politically appointed.

THE NOT SO STRANGE PART ABOUT OF ALL OF THIS JUDGES VERY RARELY EVER GET IMPEACHED AND REMOVED FROM THEIR JUDICIAL POST BUT RATHER THE JUDICIARY IN ANY STATE OR FEDERAL JUDICIARY IS PART OF THE GOOD OLE' BOY NETWORK AND NOTHING MAJOR WILL HAPPEN TO HIM.


IT'S MUCH LIKE THE US CONGRESS OR ANY STATE LEGISLATURE.

WHEN IS THE LAST TIME YOU EVER HEAR ABOUT ANY POOBUH POLITICIAN EVER GETTING IMPEACHED AND THROWN OUT OFFICE ?

IT IS DEFINITELY ABOUT TERRI. All of this is about Terri. We want her to live. Her parents want her to live. MS and his lawyer and Greer are the ones who want to kill her.

I'm afraid you're missing the boat. Terri is calssified as being in a "persistent vegetative state" only by the hand-picked doctors of her husband. This is the same husband who has consistently denied her any form of therapy, including antibiotics when she had a bacterial infection.

Other people, including other doctors, state she is responsive and somewhat alert. Some have claimed she may improve significantly with therapy, including speach therapy. The jury is out on that because Michael has barred any form of therapy.

Finally, there is significant circumstantial evidence that indicates Michael may have beaten up his wife the night she had the "heart attack", including broken bones inconsistent with a fall down the stairs (as he claims). He should have been stripped of his guardianship for her long ago, IMO.

The financial issues are secondary, frankly. If Judge Greer allows this woman to die, he MAY be contributing to the cover-up of a murder. If we allow dollars and cents to dictate that this woman - who is NOT in a vegetative state according to a number of medical and observational opinions - must die, then we are also complicit in the alleged murder.

Terri's parents have been on record offering to take over her care for years. Michael will not allow that. He has abandoned his "marriage", but will not consent to a divorce. He swore in court he would do everything possible to help Terri, yet she has not received one dime's worth of therapy from the $1.7M award he won on that pledge.

Justice cannot be measured in money.

"Mrs. Schiavo"

..........."Mrs. Shiavo's", as you call her,husband, has been in a adulterous affair, and fathered two children and is STILL living with said " other woman". Doubt if Terri could talk and express herself, she would want the " Mrs. " left on the name. !!!!!!!!

First of all, this case does not revolve around a living will (there is none), and if you want to consider a person's abuse of his ward "private", you better darn well pray you never end up with Alzheimer's or MS, Bucky.

In addition, a person's spouse, in this country, is not a possession, and if my spouse shacks up and procreates with some little chickie while I'm incapacitated, I sure don't want him deciding whether I live or die.

This is a story that has been floated but is absolutely not true and never has been verified. Some people will lie uncessantly to try to manipulate emotions and turn the public against Michael. His inlaws are ruthlessly interfering in his custodial rights as guardian.

He absolutely has the ability to divorce her. In fact, the only "grounds" for divorce other than the no-fault "irretrievable breakdown of the marriage" is mental incapacity of one of the spouses.

Interesting that you divorced your wife, you didn't kill her.

Her husband insists on following through with her wishes and I stand with him that it should be his decision and only his decision. No I do not want to kill her as some of you are saying it would be. But a persistant vegetative state will take care of things naturally without outide interferance and death will come naturally. I don't know where you get the idea he is going to kill her!

There is nothing noble about death or making a decision to disconnect artificial life support, but artificial life is not natural life and where there is no prognosis of recovery Michael has to make a painful decision and people are going to have to live with it.

She didn't die and came back and put her 3 sons through hell because she became white trash. Yes, life would have been more simple had she died, but in her case she came out of a coma after 2 months and after 6 months of rehab was turned loose on society.

Am I bitter? Yes. But only because the meddling of social services trying to create a scenario of their choosing instead of allowing me my rights. Yeah I filed for divorce but it would have happened regardless. You people think you have some kind of moral superiority that makes everything right just because you support pro life and think it extends to every facet of society.
I humble myself to your moral superiority. NOT
