Couldn't Gov. Bush call out the Guard and refuse to enforce rulings from State Courts?
Couldn't he do so and argue that it's a Federal issue due to Constitutional matters? Doesn't Terry have the benefit of being an American with Constitutional Rights, something the State cannot interfere with (without due process)??
I feel Gov. Bush has surrendered his power to the Courts.
Call out the troops, protect this Woman, and wait for the Feds to rule on this....
His brother is the President, and probably would provide some political coverage -- he's pro-life after all.

I keep thinking, maybe Jeb has something in mind? Like if there had been no reprieve (such as it is). If I lived in Florida I'd be right there at her bedside, part of a human chain. Well I keep praying for her anyway.
The Supreme Court has previously refused to hear the parent's appeal, so I doubt they would entertain any new ones.
Has the Catholic church stepped up on this? I know her family has raised the pope's edicts and her faith as an issue, but it could only help if they had some very vocal support from someone in the Catholic heirarchy. ('Course, lately some prominent Catholics seem all too ready to pull the plug on the pope...)

I'm not following--he has surrended power to the courts yet he should wait for federal courts to rule? How is that not the same thing?

It will force their hand, and if the Pres. refuses to take action, the either the court will take the case OR nothing happens and as long as Jeb is Gov. she will live..

So, any time things don't go the way we want, if we're governor, we call out the National Guard? As much as this situation cries out for rectification, it needs to be done the right way. Otherwise, how do we counter all the crap the liberals throw our way if we are no different?
The more I hear peole complain about the courts, the more I think about our gutless politicians. The courts are only one part of the balancing act, yet many spineless politicians hide behind the courts and act like they are the be all and end all whenever they make a decision. They are not! Politicians with the brass and determination to do the right thing is what we need, not wimpy little "oh well, that's what the court decided. It is BS and we are letting these spineless pols. get away with it.

I agree that the Guard shouldn't be called out for everthing which doesn't go "our" way.
However, this involves someone's life. And if the State Courts, and the Feds, refuse to protect her life given the circumstances, then yes, call out the Guard.

I would think there would be all sorts of options. I also think this case has implications for right-to-life issues far beyond this particular set of facts, and that is making people be very careful. I can only assume that there are some very good, creative lawyers working on this matter for Governor Bush and the parents.
This looks a lot like murder. I don't know that the executive branch has to stand around with its hands in its pockets and watch someone be murdered.
The problem is, a lot of things look like murder to people on the other side, i.e. abortion, death penalty, stem cell research (I am not equating the issues, simply noting the tangled and politically/culturally volatile issues).
I would imagine, though, that a good enough legal agrument could be fashioned that would provide cover to do the right thing, provided that the political will existed at SOME level of government. I'd think there would be a federal constitutional issue, but who wants to charge the husband and his lawyer and the Florida judge with conspiracy?
I hope the legal thinking isn't running around the same circles... somebody needs to think outside the box here, my instinct tells me. Every case has a "magic button" to push... unfortunately, finding it is sometimes akin to trying to start a 747 by randomly flipping switches.
