Just did our taxes here in NY and our CPA said the State of New York now wants to know, on the State income tax return, how much money you have spent purchasing things online (NOT just cigarettes - think Amazon.Com, E-Bay,etc.)for which sales tax wasn't collected.
I told her to tell the State of New York to go to hell but I think she just wrote "none" on the form. It's only a matter of time before these leeches get online businesses to collect sales taxes from every purchase.

A 2002 report (click for .pdf) from the U.S. General Accounting Office said most states tax the sale of cigarettes, and that online sales have cost them millions of dollars in lost revenue. I hate to tell them - but they can not lose that which they don't have. This so-called lost revenue were just predictions of how much they might collect, not what they actually collected.

My own dislike of cigarettes not withstanding; this sucks! An issue of tax fairness my rear end. It's all about taking money away from people who earned it so it can be spent on projects that help nobody.
All of you smokers in Michigan need to get pen-pals in more tax friendly states. When it comes time to get cigarettes you just send them the money to buy them for you. Have the smokes mailed to you and keep the 'online retailers' out of it.
This sort of reminds me of when I bought a car on eBay. I flew out to Texas to pick it up and drove it home. About two weeks later I got a letter from the state of GA asking me to kindly remit to them $1200. They had to get their cut, ya' know? Heaven forbid I should spend MY money on MYSELF without sending the government their tribute.

Laws that exempt online retailers from collecting sales taxes do not apply to tobacco excise taxes, the GAO report said. This needs to change. Either tax nothing online (preferred) or tax it all. Period.

Something that I've been wondering about for quite some time now is the federal ban of states collecting sales tax on Internet sales... Somebody would need to really examine the law very closely. Does it exempt Internet sales of all taxes or just sales taxes? I wonder if someone could take this to a federal court, and claim that the sales are exempt...
